Attached for your review and action is a resolution to approve a $102,500.00 contract with Brock Associates, Inc. to replace the wooden picnic shelter at Gallup Park and make related site improvements.   
 
Gallup Park currently has two picnic shelters. The replacement is for the older wooden shelter, which was constructed over 40 years ago and is in poor condition. The new shelter will accommodate approximately the same amount of people and is of similar size (35' by 51').The contract will include other minor improvements to the site, including removal of an old asphalt pathway, a porta john screen no longer in use, and replacement of the concrete pad upon which the shelter will sit. This will decrease the amount of impervious surface currently at the location by approximately 3,500 square feet.
 
The shelters at Gallup Park are rented continuously throughout the spring, summer and fall. It is the most popular location in the Ann Arbor park system for picnics, community gatherings and other outdoor events. The replacement of this shelter is identified in the Capital Improvements Plan, and renovations and replacements to picnic shelters are called out in the Parks and Recreation Open Space Plan.
 
This project is generously funded by a donation from Irene Fast, Ann Arbor resident, who has enjoyed Gallup Park for many years.  This donation will provide a much desired improvement that will enhance visitor experience.
 
Seven bids were received by the City for this project:

Staff recommends awarding a contract to Brock Associates, Inc. in the amount of $102,500.00 to replace the picnic shelter at Gallup Park.  A 10% construction contingency ($10,250.00) is requested to cover potential contract change orders to be approved by the City Administrator.  It is requested that an $112,750.00 contract and contingency amount be approved for the life of the project without regard to fiscal year. Funding in the amount of $92,451.00 is available from the private donation. The Parks Maintenance and Capital Improvements Millage will fund the contingency amount ($10,250.00) and other improvements ($10,049.00) that make sense to do in conjunction with the shelter replacement, such as removal of the porta john screen no longer in use.

The Park Advisory Commission recommended approval of this contract at their January 20, 2015 meeting.
 
Brock Associates, Inc. meets the living wage and prevailing wage requirements and received Human Rights approval on December, 17, 2014.

Whereas, Shelter replacement is identified in the CIP and PROS plan as park needs,
 
Whereas, A private donor has provided funding for the shelter replacement,
 
Whereas, The Park Advisory Commission recommended approval of this contract at their January 20, 2015 meeting;
 
Whereas, Competitive bids were received by Purchasing on December 4, 2014;
 
Whereas, Brock Associates, Inc. submitted the lowest responsive bid;
 
Whereas, Brock Associates, Inc. received Human Rights approval on December 17, 2014; and
 
Whereas, Funding is available in the approved FY2015 Park Memorials and Contributions Fund and the Parks Maintenance and Capital Improvements Fund;
 
RESOLVED, That City Council approve a contract with Brock Associates, Inc. to replace the wooden picnic shelter at Gallup Park and approve a construction contingency of $10,250.00 (10%) to cover potential contract change orders for a total contract amount of $112,750.00 for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
