Attached for your review and consideration for approval please find a resolution to authorize the award of a contract to E.T. MacKenzie Company in the amount of $355,900.00 for the Liberty Street, Harvard Place, and Arlington Boulevard Sanitary Sewer Extensions Project.  
 
The project will be funded by the Sewage Disposal System Fund. Funding for the project is available in the approved Sewage Disposal System Fund capital budget.

This project includes the extension of the public sanitary sewer system at three separate locations as described below. A map showing the project locations is attached.
 
Liberty Street - Work involves installation of 193 feet of new 8-inch sanitary sewer including two new sanitary sewer manholes, and extends the public sanitary sewer to allow for service connections to two vacant lots located on the west side of Ridgemor Drive south of Liberty Street.  These lots presently are not serviced by sewer, and the owner plans to build on both parcels in the immediate future. The ability to access and connect to the sanitary sewer system is necessary to obtain approval of the building permits.
 
Harvard Place - Work involves installation of 62 feet of new 8-inch sanitary sewer including two new sanitary sewer manholes.  The project will extend the public sanitary sewer to properly serve the residence at 2021 Geddes Avenue. This property is currently being served by sanitary sewer through a shared lead with the adjacent property at 1 Harvard Place, which is a non-conforming configuration. The existing sewer lead has shown signs that failure is imminent, and consequently extending the sanitary sewer to correctly service this location has become a high priority.
 
Arlington Boulevard - Work involves installation of 94 feet of new 8-inch sanitary sewer including one new sanitary sewer manhole, and extends the public sanitary sewer to serve the residence at 1210 Arlington Boulevard.  This owner is presently preparing to sell this property; however it has a failed septic drain field. The owner approached the City about extending the sanitary sewer to provide for a connection, and also to satisfy the requirements of the Washtenaw County Environmental Health Division time of sale regulations that ensure the adequate disposal of sewage from the home is in place and functioning properly.
 
The project was advertised for bid on City's website and on the Michigan Inter-governmental Trade Network (MITN) with the plans and specifications being available to interested contractors. Three bids were received and opened on August 20, 2014. The lowest responsible bid from E.T. MacKenzie Company in the amount of $355,900.00 is approximately 13% above the Engineer's Estimated Opinion of Costs.  Attached is a tabulation of the bids received for the project.
 
The project is expected to begin in late September with the Arlington Blvd and Harvard Place locations being completed by mid-November of 2014.  Work on the Liberty St location will commence in the spring of 2015 and be complete by late May or early June.
 
E.T. MacKenzie Company received Human Rights approval on May 28, 2014. All employees of E.T. MacKenzie Company, who will work on the project, will receive compensation in accordance with the Living Wage Ordinance.

Whereas, It is necessary to extend public sanitary sewer to provide service to two vacant lots located on the west side of Ridgemor Drive south of Liberty Street on which the owner plans to build in the immediate future;
 
Whereas, It is necessary to extend the public sanitary sewer to properly serve the residence at 2021 Geddes Avenue prior to failure of the existing non-conforming shared service lead;
 
Whereas, It is necessary to extend the public sanitary sewer to serve the residence at 1210 Arlington Boulevard and satisfy the requirements of the Washtenaw County Environmental Health Division time of sale regulations that ensure the adequate disposal of sewage from the property is in place and functioning properly;
 
Whereas, The City of Ann Arbor Sewage Disposal System Capital Budget includes adequate funds for the Liberty Street, Harvard Place, and Arlington Boulevard Sanitary Sewer Extensions Project;
 
Whereas, Competitive bids were received by the Procurement Unit on August 20, 2014 and E.T. MacKenzie Company was the lowest responsible bidder with a submitted bid of $355,900.00;
 
Whereas, The contract proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a Contract with said company for this construction project; and
 
Whereas, E.T. MacKenzie Company has received Human Rights approval on May 28, 2014, and its employees will receive compensation in accordance with the Living Wage Ordinance;
 
RESOLVED, That City Council approves the award of a contract in the amount of $355,900.00 to E.T. MacKenzie Company for the construction of the Liberty Street, Harvard Place, and Arlington Boulevard Sanitary Sewer Extensions Project and approves a construction contingency of $35,600.00 to cover potential contract change orders during the life of the project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;
 
RESOLVED, That funds be available in the project budget for the life of the project until expended without regard to fiscal year; and
 
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project and including the authority to approve change orders within the approved contingency.
