Memorandum

Attached for your review and approval is a resolution to establish the special assessment costs and distribution for the Pontiac Trail Improvements Project (Resolution No. 2 for Sidewalk District #45 and Curb & Gutter District #504). 

 

This project includes the reconstruction of Pontiac Trail beginning just north of Skydale Drive to just south of the bridge over M-14. In line with the City's Complete Streets Policy, the project will also be adding on-street bike lanes and constructing a new sidewalk along the east side of Pontiac Trail to fill in existing sidewalk gaps and to provide pedestrian access to Olson Park and Dhu Varren Road. In addition to the sidewalk, approximately 1,960 feet of curb and gutter is being added north of Skydale along Pontiac Trail to protect existing wetland areas. 

 

A public meeting was held on June 6, 2013 to gather feedback and develop the scope of work.  During this public meeting, the residents expressed interest in extending the sidewalk on the east side of Pontiac Trail to provide pedestrian access to Dhu Varren Road and Olson Park.  This sidewalk would provide a connection to the existing asphalt path that meanders through Olson Park on the north side of Dhu Varren Road on the east side of Pontiac Trail. 

 

Per Chapter 13, Section 1:282, of the City Code, the cost for the addition of new sidewalk and curb & gutter where none currently exists is borne by the parcels that benefit from the improvements.

 

Staff has prepared for your review and approval, the estimated costs of the curb and gutter and sidewalk installation, and the distribution of the assessable portion of said costs, which is summarized in the attached table. The special assessment amounts will be distributed to the properties in proportion to the length of sidewalk and/or curb & gutter that will be installed adjacent to each property, depicted in the attached drawing.

 

Total assessable cost for new sidewalk:  $34,597.64

Total assessable cost for new curb & gutter:  $37,620.85

Total assessable cost:  $72,218.49

 

Resolution No. 1, which authorized staff to proceed with the design of the sidewalk and curb & gutter (R-14-028) was previously approved on January 21, 2014.  An informal administrative meeting to discuss the special assessments was held with the affected property owners on May 7, 2014. No substantial objections regarding the project or the special assessments were raised.

Whereas, The City Council has directed the City Administrator to prepare plans, specifications, and estimates of cost for the construction of curb and gutter and sidewalk described as follows:

 

Pontiac Trail Improvements Project from north of Skydale Drive to just south of the bridge over M-14 - 1) New sidewalk on the east side of Pontiac Trail, between Skydale and Dhu Varren Road ; Sidewalk Special Assessment District No. 45; 2) Curb and Gutter along both sides of the roadway extending north from Skydale approximately 1,000 feet; Curb and Gutter Special Assessment District No. 504.

 

Whereas, The City Administrator has had the same prepared and has filed the same with the City Clerk together with his recommendations as to what part of the cost thereof should be paid by special assessment and what part should be paid by the City at large, and the lands which should be included in the special assessment districts; and

 

Whereas, The same has been presented to the City Council and examined and reviewed by the Council;

 

RESOLVED, That the plans, specifications, estimate of cost, and the recommendation of the City Administrator be filed with the City Clerk and be available for public examination;

 

RESOLVED, That the plans, specifications, estimate of cost, and recommendations of the City Administrator for said improvement as filed with the City Clerk by the City Administrator and presented to Council be approved;

 

RESOLVED, That the City Council hereby determine to proceed with the acquisition and construction of the curb and gutter and sidewalk described as follows:

 

Pontiac Trail Improvements Project from north of Skydale Drive to just south of the bridge over M-14 - 1) New sidewalk on the east side of Pontiac Trail, between Skydale and Dhu Varren Road; Sidewalk Special Assessment District No. 45; 2) Curb and Gutter along both sides of the roadway extending north from Skydale approximately 1,000 feet; Curb and Gutter Special Assessment District No. 504.

 

RESOLVED, That the City Council determine the cost of said improvements, including all incidentals, to be $72,218.49, and that of said total cost, the sum of $31,467.98, be paid by special assessment upon the property specially benefited with the City, and that a sum of $40,750.52 be paid by the City as City Share future recoverable (Land Outside the City);

 

RESOLVED, That funding to cover the cost of the design, construction, and inspection of these improvements is included in the FY14 Capital Budget;

 

RESOLVED, That the following described lots and parcels of land be designated as constituting the special assessment district against which the cost of said improvement shall be assessed, or against which an improvement charge shall, pursuant to Chapter 13, Section 1:282, of the City Code be levied (see drawing on file in the City Clerk’s Office);

 

RESOLVED, That the City Assessor be herby directed to prepare a special assessment roll in accordance with the foregoing determination of the City Council, and the file the same, together with his certificate attached thereto, with the City Clerk for presentation to the City Council; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
