Resolution to Approve a Professional Services Agreement with Black and Veatch, for the Water Treatment Plant Alternatives Analysis Project ($220,339.00)

Your approval is requested to approve a Professional Services Agreement with Black and Veatch in the amount of $220,339.00 for the Water Treatment Plant Alternatives Analysis.
All public drinking water systems are regulated by the Michigan Department of Environmental Quality (MDEQ). The MDEQ performs an evaluation of all public water system every three years. In addition, the Michigan Safe Drinking Water Act (Act 399) requires all public water systems to periodically complete a master plan. The MDEQ performed an evaluation at the City of Ann Arbor in 2013 and the City completed a Facilities Master Plan in 2006. In both instances, the recommendations included modifications or replacement of the Water Treatment Plant's Plant 1 treatment basins. The basins were built in 1938, are inefficient, do not meet current recommended design standards, and have exceeded their useful life. These basins provide reliability on average days and capacity during peak demand periods.
The goal of the Water Treatment Plant Alternatives Analysis project is to evaluate the need and feasibility for addressing several challenges facing the Water Treatment Plant, including the replacement of the Plant 1 treatment basins. Other items to be addressed include, but are not limited to, source capacity and quality during extended periods of drought, variations in water quality, and planning for compliance with future regulations. The project will also evaluate and provide recommendations on the Water Treatment Plant's solids handling and disposal options.
The project will provide feasibility level evaluations of source of supply and system reliability alternatives based on economic and non-economic considerations, with a focus on ensuring continued reliable service of the Ann Arbor drinking water system over a 20-year planning horizon. The alternatives analysis will establish water quality goals, analyze source water configuration, evaluate available water treatment processes and sludge handling processes, determine space requirements, and provide preliminary engineering cost estimates for the design and construction of infrastructure to replace the 1938 treatment basins.
The City received five proposals for this work. Two of the firms that submitted proposals were then interviewed by a selection committee. It is recommended that City Council approve the professional services agreement with Black and Veatch to complete the Water Treatment Plant Alternatives Analysis. Black and Veatch is being recommended because of their project team's experience with similar projects, approach to the alternatives analysis, and detail and completeness of scope. City staff negotiated the contract scope for a cost not-to-exceed of $220,339.00.
Black and Veatch received human rights approval on November 22, 2013 and complies with the living wage ordinance.
This project is to be funded from the approved Water Supply System Capital and Operating budgets.

Whereas, The City issued Request for Proposal #881 for a Water Treatment Plant Alternatives Analysis;
Whereas, Of the five proposals received, Black and Veatch was selected as the most qualified consultant with the most comprehensive scope at a competitive price;
Whereas, The Water Treatment Plant Alternatives Analysis project will evaluate the need and feasibility for addressing several challenges facing the Water Treatment Plant, including the replacement of the Plant 1 treatment basins
Whereas, The tasks to be completed in the Water Treatment Plant Alternatives Analysis are a necessary first step in the process to implement the water system recommendations by the Michigan Department of Environmental Quality;
Whereas, The Water Treatment Plant Alternatives Analysis will be funded from the approved Water Supply System Capital and Operations and Maintenance budgets; and
Whereas Black and Veatch has received Human Rights approval on November 22, 2013, and complies with the living wage ordinance;
RESOLVED, That Council accepts the proposal and awards a Professional Services Agreement to Black and Veatch in the amount not to exceed $220,339.00;
RESOLVED, That a contract contingency amount of $22,000.00 be established and that the City Administrator be authorized to approve additional change orders to the contract with Black and Veatch, not to exceed $22,000.00 in order to satisfactorily complete this project;
RESOLVED, That Council approve the contract for the life of the project with funds to be available until expended without regard to fiscal year;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract for services after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
RESOLVED, That the City make the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds.
