Resolution to Award a Construction Contract to Doan Construction Company (Bid No. 4320, $1,707,037.00) for the 2014 Ramp & Sidewalk Repair Project
Memorandum
Attached for your review and approval is a resolution to award a construction contract to Doan Construction Company in the amount of $1,707,037.00 for the 2014 Ramp & Sidewalk Repair Project.  
 
The 2014 Ramp & Sidewalk Repair Project will consist of the repair of deficient sidewalks in approximately 20% of the City in 2014, as part of the third year of a 5-year program to perform maintenance on the City's entire sidewalk system.
 
The project also includes the continued replacement of sidewalk curb ramps to meet the requirements of the Americans with Disabilities Act (ADA) as required by our Consent Decree.
 
The Ramp & Sidewalk Repair Project is created as a unit price contract with the understanding that the actual quantities used in construction will vary. The attached map shows the areas of the City and their schedule for repair in 2014. Depending on the status of the budget upon completion of work in the identified areas, additional areas may be added to the contract to take advantage of favorable pricing.
 
Project specifications were distributed electronically to contractors, subcontractors, and suppliers. Three bids were received and opened on March 5, 2014. The lowest responsible bid, in the amount of $1,707,037.00 is $48,237.00 higher than the engineer's estimate of $1,658,040.00.  A tabulation of the bids is also attached.
 
Doan Construction Company received Human Rights and Living Wage approval on April 18, 2013. All employees of Doan Construction Company, assigned to work on the project will receive compensation in accordance with the Living Wage Ordinance.
The project will be funded from the approved Street Millage capital budget.

Whereas, The City of Ann Arbor approved Street Millage capital budget includes sufficient funds for the annual Ramp & Sidewalk Repair Project;
 
Whereas, The 2014 Ramp & Sidewalk Repair Project includes the repair of deficient sidewalks in approximately 20% of the City and the continued replacement of sidewalk curb ramps to meet the requirements of the Americans with Disabilities Act (ADA) and the approved Consent Decree;
 
Whereas, The 2014 Ramp & Sidewalk Repair Project is necessary to maintain high quality pedestrian facilities in the City of Ann Arbor;
 
Whereas, Competitive bids were received by Procurement on March 5, 2014 and Doan Construction Company was the lowest responsible bidder at $1,707,037.00;
 
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City there for, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a Contract with said company for the performance of the work; and
 
Whereas, Doan Construction Company received Human Rights approval on April 18, 2013, and its employees will receive compensation in accordance with the Living Wage Ordinance;
 
RESOLVED, That a contract in the amount of $1,707,037.00 be awarded to Doan Construction Company for the construction of the 2014 Ramp & Sidewalk Repair Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That a contingency amount of $170,000.00 be established within the project budget and that the City Administrator be authorized to approve change orders to the construction contract with Doan Construction Company, not to exceed $170,000.00 in order to satisfactorily complete this project; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
