Resolution Accepting Easement for Stormwater Drainage Facilities at 3500 Fox Hunt Drive from Robert A. Young and Andrea G. Jensen (8 Votes Required)
Memorandum
There is a resolution before you to accept an easement from Robert A. Young and Andrea G. Jensen, husband and wife, for stormwater drainage facilities and to approve payment for that easement.
The stormwater drainage facilities were installed in the 1980s. However, it recently came to the City's attention that stormwater facilities were installed near but not within any easement; an easement on an adjacent property likely was intended to be used for those facilities. This easement is required for the City to be able to continue to use the property for the stormwater drainage facilities, and to be able to access the facilities for inspection, maintenance and repair activities.
The easement has been reviewed by the required City service areas. The easement is in standard form and is conveyed to the City at a cost of $60,000.00, based on the appraised value of the easement that the City obtained.
Approval of the easement is recommended.

Whereas, Robert A. Young and Andrea G. Jensen are the owners of property commonly known as 3500 Fox Hunt Drive, more fully described at Liber 3529, Page 203, Washtenaw County Records; and
Whereas, Upon receipt of payment therefor, Robert A. Young and Andrea G. Jensen are prepared to execute and deliver a grant of easement for stormwater drainage facilities and appurtenances, being more particularly described as:
A part of Lot 50, "Earhart West" Subdivision in the Northeast ¼ of Section 26, Town 2 South, Range 6 East, Washtenaw County Records, according to the plat thereof as recorded in Liber 23 of Plats, Pages 5-10, Washtenaw County Records described as: Beginning at the Southwest corner of said Lot 5; thence along the West line of said Lot 50 N00°22'50" 132.52 feet to the South line Green Road South (66 feet wide); thence along said South line 25.00 feet in the Arc of a 330.00 feet radius circular curve to the left, said curve having a Central Angle of 4°20'26" and a Chord which bears N22°04'08" E 24.99 feet; thence S16°37'32" E 168.06 feet to the South line of said Lot 50; thence along said South line N84°35'45" W 56.85 feet to the point on beginning, containing 5,057 square feet of land, more or less. Being a part of Tax Parcel I.D. No. 09-26-102-071.
RESOLVED, That the City Council approves payment of $60,000.00 to Robert A. Young and Andrea G. Jensen, husband and wife, for an easement for stormwater drainage facilities across 3500 Fox Hunt Drive; and
RESOLVED, That the City of Ann Arbor accepts the grant of that easement for stormwater drainage facilities across 3500 Fox Hunt Drive from Robert A. Young and Andrea G. Jensen.
