Memorandum
Attached for your consideration is a resolution authorizing limitations on solicitor/peddler permits and sidewalk occupancy permits, allowing outdoor sales and the parking of motor vehicles in the front open space of private properties in the vicinity of Michigan Stadium and authorization for street closures for the NHL Winter Classic hockey game.
 
The NHL, the applicant, has contracted with the University of Michigan for use of Michigan Stadium for the Winter Classic hockey game on January 1, 2014.  January 2, 2014 will serve as the back-up date in case of inclement weather.  The City has been working with NHL and University staff to coordinate security and logistics for this event.  City staff anticipates that this event will be similar to a University of Michigan football game, and recommends that Council apply relevant City Code provisions for vending and parking to ensure a safe and well-ordered event.
 
Chapter 47 (Streets) and Chapter 79 (Solicitors and Peddlers) allow Council to determine by resolution that on certain dates congestion in a part of the City will be too great to permit peddling and soliciting and sidewalk occupancy.  Approval of this resolution will make invalid any current peddler/solicitor and sidewalk occupancy permits for the Michigan Stadium area on that day and direct staff to not issue any new permits for this area.
 
City staff anticipates that temporary outdoor sales and parking of motor vehicles in the front open space of nearby properties will be desired by the community during this event.  Chapter 55 (Zoning) allows for City Council, by resolution, to designate special event temporary outdoor sales areas, with appropriate conditions and standards.  Chapter 59 (Off-Street Parking) allows for the prohibition on front open spaces parking to not apply on special event dates designated by City Council.
 
Further, this resolution seeks approval of the closing of the following:  
 
·      E. Keech Street between S. Main and Greene streets, limiting access to parking permit holders on Greene Street from East Hoover to Keech streets
·      The westbound right turn lane on E. Stadium Boulevard (onto S. Main Street) just south of the Michigan Stadium,
·      S. Main Street closed to both local and through traffic from Stadium Boulevard to Pauline
 
These closures would be effective three hours before the game to the end of the game, with the exception of south bound S. Main Street which will be closed beginning one hour before the game to the end of the game.  These streets currently close for each University of Michigan home football game.
 
Vehicle access from the neighborhood streets onto the closed area of S. Main Street would be either prohibited or restricted at police controlled access points depending on the street to accommodate people needing ingress or egress to properties fronting S. Main Street that have no side street access.  The closed portion of these streets will remain available for pedestrian use and emergency vehicle response to the area.
 
The NHL is also requesting closure of the following street to accommodate bus a staging location and to assist buses making return trips to pick up additional passengers after the game from the beginning of the 3rd period to one hour after the game is over:
 
·      East Hoover Avenue between S. Division and Greene Street
 
The NHL agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, to comply with all City regulations governing the use of the streets, and will reimburse the City for all event expenses.

Whereas, The NHL will hold the Winter Classic hockey game at Michigan Stadium on Wednesday, January 1, 2014 or Thursday, January 2, 2014;
 
Whereas, This event will be similar in scale and operations to a University of Michigan football game, and it is desirable to apply relevant City Code provisions for vending and parking to ensure this event is safe and well-ordered;
 
Whereas, Under Chapter 47 (Streets) and Chapter 79 (Solicitors and Peddlers), City Council may determine by resolution that on certain dates congestion in the City or a part of the City will be too great to permit peddling/soliciting and sidewalk occupancy activities;
 
Whereas, Under Chapter 55 (Zoning) and Chapter 59 (Off-Street Parking), City Council may designate a special event date that will allow temporary outdoor sales and parking of motor vehicles in the front open space;
 
Whereas, The following street closures have been requested by the applicant:
 
·      E. Keech Street between S. Main and Greene streets, limiting access to parking permit holders on Greene Street from E. Hoover to Keech streets
·      The westbound right turn lane on E. Stadium Boulevard (onto S. Main Street) just south of the Michigan Stadium,
·      S. Main Street closed to both local and through traffic from Stadium Boulevard to Pauline

Whereas, The NHL is also requesting closure of the following street to accommodate a bus staging location and to assist buses making return trips to pick up additional passengers after the game from the beginning of the 3rd period to one hour after the game is over:
 
·      East Hoover Avenue between S. Division and Green Street
 
Whereas, The street closures will be signed, barricaded and properly supervised;
 
Whereas, The NHL agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, and to comply with all City regulations governing the use of the street; and
 
Whereas, Notification of the street closing will be provided through the City's website and through the University of Michigan's communications office;
 
RESOLVED, That City Council designates the Winter Classic on January 1, 2014 as a special event date and January 2, 2014 as the alternate special event date in case the Winter Classic is postponed from January 1, 2014 to January 2, 2014;
 
RESOLVED, That the Special Event Provisions for the NHL Winter Classic Hockey Game are applicable on the actual day of the event.
 
RESOLVED, That any existing peddler/solicitor permits or sidewalk occupancy permits shall not be valid on the day of the NHL's Winter Classic Hockey Game within the area surrounded by the following streets and including the public right-of-ways:
 
·      S. State Street from E. Hoover Street to the Ann Arbor Railroad tracks
·      Along the Ann Arbor Railroad tracks from S. State Street to the viaduct on W. Stadium Boulevard
·      W. Stadium Boulevard from the viaduct to S. Main Street
·      S. Main Street from W. Stadium Boulevard to Hill Street
·      Hill Street from S. Main Street to S. Division Street
·      S. Division Street from Hill Street to E. Hoover Street
·      E. Hoover Street from S. Division Street to S. State Street
 
Also prohibited are the public right-of-way areas on:
 
·      S. Main Street from Scio Church Road to W. Stadium Boulevard
·      W. Stadium Boulevard from S. Main Street to Prescott Avenue.
 
RESOLVED, That City staff shall not issue any new solicitor/peddler permits or sidewalk occupancy permits for the above-noted area on the day of NHL's Winter Classic Hockey Game;
 
RESOLVED, That City Council establish a special events temporary outdoor sales area for the Winter Classic on the day of NHL's Winter Classic Hockey Game and that the owners of commercially and office-zoned property fronting on the following streets may use their private yard areas for outdoor sales and display:
 
·      West side of South Main Street between Stadium Blvd. and Hoover Street
·      East side of South Main Street from 1011 South Main to Hoover Street
·      North side of Hoover Street between South Main and South State Streets North side of West Stadium Blvd.
·      Between S. Main and S. State Streets
 
RESOLVED, That the following standards be in force for outdoor sales and display areas on private property on the day of NHL's Winter Classic Hockey Game:
 
1. Ten-foot minimum setback from the edge of the sidewalk (or right-of-way line if there is no sidewalk) that is farthest from the street.
2. Compliance with Fire Code requirements.
3. Compliance with Health Code requirements.
4. Compliance with Michigan Liquor Control Commission requirements.
5. Permit shall be posted and clearly visible at all times when sales take place.
6. A Zoning Compliance Permit shall be required.
 
RESOLVED, That City Council designates the day of NHL's Winter Classic Hockey Game as a special event date on which the prohibition on front open space parking does not apply; and
 
RESOLVED, the following streets will be closed to traffic:
 
·      E. Keech Street between S. Main and Greene streets, limiting access to parking permit holders on Greene Street from E. Hoover to Keech streets
·      The westbound right turn lane on E. Stadium Boulevard (onto S. Main Street) just south of the Michigan Stadium,
·      S. Main Street closed to both local and through traffic from Stadium Boulevard to Pauline
