Memorandum
Attached for your review and approval is a resolution to approve a Professional Services Agreement, in the amount of $212,785.00 with CDM Smith Michigan, Inc. for engineering consulting services for the Springwater Subdivision Improvements Project.  In addition, this resolution also authorizes the City Administrator to approve change orders to the Professional Services Agreement with CDM Smith Michigan, Inc. up to the total of $10,640.00.
 
The City of Ann Arbor is planning to undertake the complete reconstruction of multiple streets in three phases beginning in 2014 within the Springwater Subdivision. The approved FY2014-2019 Capital Improvements Plan includes the following three projects: TR-SC-14-22 - Springwater Subdivision Street Reconstruction; UT-ST-10-04 - Springwater Subdivision Storm Sewer Replacement and UT-WT-14-18 - Springwater Subdivision Water Main Replacement, which are collectively known as the Springwater Subdivision Improvements Project. This project includes a reconstructed roadway section, storm sewer upgrades, storm water quality improvements, water main replacement, replacement of curb and gutter, and the construction of new sidewalk and/or the filling in of sidewalk gaps within the project limits.
 
The Consultant will prepare a Storm Water Plan and Impact Analysis for the entire Springwater Subdivision for submittal to the MDEQ Nonpoint Source Program, as required. This will be prepared under the assumption that all streets in this subdivision will eventually be reconstructed. The Plan will include conceptual design of storm water improvements such as bioretention areas with native plantings and grasses (rain gardens), hydrodynamic separators (pre-cast, swirl chamber type systems), oversized conveyance/detention pipes, and storm structures with internal overflow weirs, or other applicable best management practices.
 
The Consultant will also be required to prepare all the necessary construction plans and specifications suitable for bidding purposes for the Phase I portion of the project (see attached map), which includes water main replacement, storm sewer improvements, road construction, and the potential installation of new sidewalks. The Consultant will work with City Staff to develop the full scope for the road reconstruction, which could include complete reconstruction of the subgrade, replacement of curb & gutter, and adjustments to the vertical alignment.  In addition, the Consultant will be required to develop and implement a "Public Engagement Strategy" in order to facilitate interaction and input with all interested and relevant stakeholders throughout the duration of the project.  Construction of Phase I of this project is expected to begin in the spring of 2014, with Phase II and III construction to follow in 2015 and 2016, respectively.
 
On April 24, 2013, a request for proposal for professional engineering services was posted to the Michigan Inter-governmental Trade Network (MITN) BidNetĀ® website and proposals from eight consultants were received on May 22, 2013.  A team of staff members reviewed all of the proposals and narrowed the selection to five consulting firms whose fee quotations were opened and evaluated.  Based on their professional qualifications, past experience with similar projects and with the City, and fee proposals, four consultants were invited to interview with the review team.  After interviews were conducted, CDM Smith Michigan, Inc. was selected as the most qualified consulting firm based on their previous work experience, their proposed work plan, their competitive fee schedule, and their interview.  
 
CDM Smith Michigan, Inc. received Human Rights approval on May 13, 2013, and complies with the living wage ordinance.

Whereas, The City of Ann Arbor Adopted FY14 Capital Budget includes the Springwater Subdivision Improvements Project;
 
Whereas, It is necessary to replace the existing roads, storm sewers and water mains to ensure a safe and reliable infrastructure;
Whereas, the services of a professional engineering firm are needed to assist the City with the engineering design and to produce construction plans and specifications for Phase I of the Springwater Subdivision Improvements Project; and to develop a stormwater plan for the entire neighborhood;
 
Whereas, CDM Smith Michigan, Inc. has demonstrated the required experience, qualified professionals, and competitive fee schedule for the required services; and
 
Whereas, CDM Smith Michigan, Inc. received Human Rights approval on May 13, 2013, and complies with the living wage ordinance;
 
RESOLVED, That City Council approves a professional services agreement with CDM Smith Michigan, Inc. in the amount of $212,784.00 for the engineering consulting services for the Springwater Subdivision Improvements Project;
RESOLVED, That City Council approves a contingency of $11,000.00 to finance change orders to be approved by the City Administrator, to be available until expended without regard to fiscal year;
 
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said professional services agreement, after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That City Council authorizes the City Administrator to take necessary administrative actions to implement this resolution.
