Memorandum
On March 4, 2013, City Council unanimously approved acceptance of a Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant for 75% of the total project cost to demolish two City-owned storage structures located at 721 North Main Street.  The two structures are located in the floodway of the Allen Creek overland flow.  One of the two structures is a 50 ft x 116 ft (5800 sf) structure previously used by the City for road salt storage.  The second structure is a 36 ft x 200.5 ft (7220 sf) storage building, formerly used for large vehicle storage.  The former maintenance garage facility on the 721 North Main Street site is located outside of the floodway (but still in the floodplain) and is not part of this grant project; thus it will remain in place.    
 
The demolition includes the removal of: the two City-owned buildings at 721 North Main Street and their foundations; all bollards and appurtenances surrounding the buildings; the asphalt surface between them; and, removal and disconnection of two stormwater inlets and stormwater piping that were intentionally connected to the sanitary system. Work to be done also includes site restoration; all disturbed areas shall be graded out, topsoil applied, and seeded and mulched to establish native prairie vegetation.
 
A lead and asbestos survey was conducted for the two buildings on April 22, 2013. The survey found no Regulated Asbestos Containing Material (RACM), lead or cadmium.
 
ITB 4286 received 11 bids; E.T. MacKenzie Company submitted the lowest responsible bid. (See attached bid sheet).
 
Staff recommends acceptance of E.T. MacKenzie Company's bid in the amount of $31,618.00 to demolish two structures at 721 North Main Street and approval of a 10% construction contingency in the amount of $3,161.00 to cover potential change orders to be approved by the City Administrator, and that the $34,779.00 be approved for the life of the project.  Funds are available in the existing capital project budget for the 25% matching funds;
 
E.T. MacKenzie Company meets the living wage and prevailing wage requirements and received Human Rights approval April 8, 2013.
 
All work is to be completed by August 30, 2013 in order to be reimbursed by FEMA, as the Hazard Mitigation Grant period ends September 17, 2013.

Whereas, The two City-owned storage buildings at 721 North Main Street ceased being utilized approximately five years ago, are located in the floodway of Allen Creek and are an obstruction to the flow of floodwater;
 
Whereas, The City of Ann Arbor Flood Mitigation Plan (March 2007) recommends opening up the floodway by preventing new structures and removing existing structures from the floodway to create greenways;
 
Whereas, City Council unanimously approved acceptance of a Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant for 75% of the total project cost to demolish the two City-owned storage structures located at 721 North Main Street on March 4, 2013;
 
Whereas, Of the 11 bids received, E.T. MacKenzie Company submitted the lowest responsible bid;
 
Whereas, E.T. MacKenzie Company received Human Rights approval on April 8, 2013; and
 
Whereas, Funds are available in the existing capital project budget for the 25% matching funds;
 
RESOLVED, That City Council approves a contract with E.T. MacKenzie Company to demolish the two City-owned structures located in the Allen Creek floodway at 721 North Main Street in the amount of $31,618.00 and approves a construction contingency of $3,161.00 (10%) to cover potential contract change orders during the life of the project;
 
RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
