Resolution to Approve a Change Order with Saladino Construction Company for FY13 Annual Miscellaneous Concrete ($50,000.00), FY14 Annual Miscellaneous Concrete ($50,000.00) and FY15 Annual Miscellaneous Concrete (50,000.00)

Attached for your review and approval, please find a resolution approving a change order in the total amount of $150,000.00 for the contract with Saladino Construction Company for the Annual Miscellaneous Concrete Repairs Project (ITB-4237). This change order revises the original contract amount of $426,000.00 to $576,000.00.
The miscellaneous concrete work consists of the replacement of concrete including curb and gutter, sidewalk, request based corner ramps, driveway approaches and all relate work. The work addresses the needs of all of Field Operations Services.
On August 8, 2012, by Resolution R-12-379,City Council approved the existing contract with Saladino Construction Company based on ITB-4237 for a total amount of $426,000.00, which was based on estimated quantities. In the course of the work, staff found a number of additional repairs that will require an additional $150,000.00 worth of work over the remainder of FY13 and in FY14 and FY15 in order to complete all the needed work.
The change order increases the existing contract amount by $150,000.00, for a final total of $576,000.00. The proposed change order has received the contractor's acceptance.
Saladino Construction Company has received Human Rights approval on August 13, 2012. All employees of Saladino Construction Company assigned to work on the project will receive compensation in accordance with the Living Wage Ordinance and Saladino Construction Company received Living Wage Ordinance approval on April 18, 2013.
Funding for this change order for FY13 ($50,000.00) is available in the approved Field Operations Service Unit Budget. Funding for FY14 and FY15 is anticipated to be available in the FY14 and FY15 budgets and the change order amounts for FY14 ($50,000.00) and FY15 ($50,000.00) are subject to the availability of funding.

Whereas, Saladino Construction Company was awarded a contract on August 8, 2012 by Resolution R-12-379 for a total amount of $426,000.00 for the Annual Miscellaneous Concrete Repairs Project for FY13, FY14 and FY15 (ITB-4237);
Whereas, Additional work in the amount of $150,000.00 is required to repair additional miscellaneous concrete for a total amount of $576,000.00;
Whereas, Funding in the amount of $50,000.00 is available in the approved FY13 Field Operations Services Unit Budget;
Whereas, Funding in the amount of $50,000.00 each year is anticipated to be available in the FY14 and FY15 Field Operations Services Unit Budget; and
Whereas, Saladino Construction Company has received Human Rights approval on August 13, 2012, and Living Wage Ordinance approval on April 18, 2013;
RESOLVED, That City Council approves the Change Order to the Contract with Saladino Construction Company in the amount of $150,000.00 total (FY13 - $50,000.00, FY14 - $50,000.00 and FY15 - $50,000.00) for the Annual Miscellaneous Concrete Project, subject to the availability of funds in FY14 and FY15; and
RESOLVED, That Council authorize the City Administrator to take the necessary administrative actions to implement this resolution.
