Resolution to Extend Temporary Suspension of Funding of New Art Projects from Percent for Art Funds
Memorandum
This resolution proposes to extend the previous City Council resolution suspending the commitment or use of funds already set aside through the percent for art program, which is set to expire on April 1, 2013. The Public Art Task Force desires a short additional time to conclude its study and prepare recommendations to City Council regarding amendments to City Code with respect to public art. This extension would allow Council time to decide whether and how it wants to amend the Public Art Ordinance before expenditure of existing funds resumes. As before, projects that are in process, including the East Stadium Bridges, Kingsley Rain Garden, and Argo Cascades projects will continue to move forward.

Whereas, On December 3, 2012, City Council approved Resolution R-12-0535 that suspended the commitment or use of funds already set aside through the percent for art program in the FY 2013 budget and in prior years’ budgets, with certain exceptions;
Whereas, This temporary suspension was to allow time for an appointed Council committee (the Public Art Task Force) to study and recommend amendments to the City Code relative to public art, and to allow City Council time to consider those recommendations;
Whereas, The Public Art Task Force is still in the process of studying and preparing those recommendations and desires a short additional time to complete this work; and
Whereas, The suspension set forth in Resolution R-12-0535 is set to expire on April 1, 2013;
RESOLVED, That City Council hereby extends the existing suspension on the commitment or use of funds already set aside through the percent for art program in the FY 2013 budget and in prior years’ budgets, with under the same terms and subject to the same exceptions as in resolution R-12-0535 until May 31, 2013; and
