Memorandum
Attached for your review and approval is a resolution to award a construction contract to Barrett Paving Materials, Inc. in the amount of $3,583,944.55 for the 2013 Street Resurfacing Project.  
 
This year's program consists of the resurfacing of approximately two major streets and nine or more local streets located throughout the City.  Depot Street (Main to Carey) was included as part of the original bid package. However, early indications from the Allen Creek Railroad Berm Opening Feasibility Study show possible solutions could impact the storm sewer within Depot Street.  Therefore, Depot Street will not be included in this year's resurfacing program.  Other local streets, yet to be determined, will be substituted for Depot Street this year.
 
Attached is the expected street list. Construction is scheduled to begin approximately April 15, 2013 and to be completed in October 2013.  A tentative timeframe for construction is shown, however, the exact schedule for each street will be adjusted to best coordinate with scheduled City events (such as Art Fair, U of M home football games, and in-session school days) and other construction projects.
 
The Street Resurfacing Project is created as a unit price contract with the understanding that the actual quantities used in construction will vary. Reflecting this flexibility, if any streets on the existing list are removed for any reason, other streets within the City may be substituted.  If the funds are depleted prior to the completion of all the streets listed on the attachments, the construction contract will be terminated and the balance of the streets will be deferred to a future Resurfacing Project.
 
Traffic Control During Construction
For all the streets, local access will be maintained throughout the construction.  To allow for construction on the major streets, the number of traffic lanes will be reduced to allow construction on one half of the street at any time:
 
·      State Street (Oakbrook to Eisenhower).  Traffic will be reduced to one lane in both directions.  No detour will be used.  
·      Barton Drive (Pontiac Trail to Plymouth).  Westbound traffic will be maintained and eastbound traffic will be detoured.  
 
Public Outreach
In early March, an informational notice was mailed to all residents within the resurfacing limits of each street. The notice informed the residents of the project and provided resources to find more information (staff contacts and the web page; www.a2gov.org/RoadConstruction <http://www.a2gov.org/RoadConstruction>). The notice also invited people to the public meeting scheduled for the evening of March 19, 2013.
 
Residents will receive another notification prior to construction beginning on each street and regular e-mails will be sent to keep people informed on the progress of the construction.
 
Bidding
Plans and specifications were distributed electronically to contractors, subcontractors, and suppliers. Three bids were received and opened on February 25, 2013. The lowest responsible bid, in the amount of $3,583,944.55 is approximately 2% higher than the engineer's estimate of $3,513,655.50.  A tabulation of the bids is attached.
 
Barrett Paving Materials, Inc. received Human Rights approval.  All employees of Barrett Paving Materials, Inc., assigned to work on the project will receive compensation in accordance with the Living Wage Ordinance.
 
The project will be funded primarily from the Street Resurfacing Millage

Whereas, The City of Ann Arbor Adopted 2013 Capital Budget includes sufficient funds for the Annual Street Resurfacing Project;
 
Whereas, The 2013 Street Resurfacing Project includes the resurfacing and/or reconstruction approximately 2 major streets and 9 local residential streets located throughout the City;
 
Whereas, The 2013 Street Resurfacing Project is necessary to maintain high quality streets in the City of Ann Arbor;
 
Whereas, Competitive bids were received by Procurement on February 25, 2013 and Barrett Paving Materials, Inc. was the lowest responsible bidder at $3,583,944.55;
 
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a Contract with said company for said construction project; and
 
Whereas, Barrett Paving Materials, Inc. received Human Rights approval and its employees will receive compensation in accordance with the Living Wage Ordinance;
 
RESOLVED, That a contract in the amount of $3,583,944.55 be awarded to Barrett Paving Materials, Inc. for the construction of the 2013 Street Resurfacing Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That a contract contingency amount of $354,000.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Barrett Paving Materials, Inc., not to exceed $354,000.00 in order to satisfactorily complete this project;
 
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this project, including issuing Traffic Control Orders for the streets included in the 2013 Street Resurfacing Project,  including parking prohibition as needed in excess of 1 block and/or 90 days; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
