Attached for your review and consideration, please find a resolution to approve an Agreement for Professional Services with Materials Testing Consultants, Inc. (MTC) for construction materials testing services in the amount of $75,752.00 for the improvements to Miller Avenue between Maple Road and Newport Road.
 
Project work involves the complete reconstruction of the roadway to include improved bicycle lanes, pedestrian crossings with raised islands, and intermittent left turn lanes to facilitate improved traffic flow; installation of new sidewalks, sidewalk ramps and concrete bus stop pads to comply with current Americans with Disabilities Act (ADA) standards; storm water improvements that include new storm sewers with detention, bio-swales, and rain gardens; and utility work that involves replacing a distribution water main within the project limits and a portion of sanitary sewer.
 
Construction is anticipated to begin in mid/late April 2013 and be complete by early November 2013.
 
We received proposals from eight firms for the required construction materials testing services.  Project Management staff evaluated the proposals and selected MTC based on the proposal, staff qualifications, past involvement with similar projects, and cost.  
 
MTC received Human Rights and Living Wage approval on February 8, 2013 (pending).  
 
Services to be performed include all the required testing for soils, aggregates, asphalt, and concrete.  Funds for the requested services are available in the project budget for the improvements to Miller Avenue between Maple Road and Newport Road.

Whereas, it is necessary to retain a qualified testing firm to perform testing services for the improvements to Miller Avenue between Maple Road and Newport Road;
 
Whereas, proposals were received by the Procurement Unit and evaluated by Project Management Services Unit staff on the basis of staff qualifications, past involvement with similar projects, proposed work plan, and cost;
 
Whereas, Materials Testing Consultants, Inc. of Ann Arbor, Michigan has submitted to the City a proposal for the necessary services, setting forth the services to be performed by said firm and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, Materials Testing Consultants, Inc. received Human Rights and Living Wage approval on February 8, 2013; and
 
Whereas, the required funds for the construction materials testing services are available in the project budget for the improvements to Miller Avenue between Maple Road and Newport Road;
 
RESOLVED, that an Agreement for Professional Services with Materials Testing Consultants, Inc. in the amount of $75,752.00 be approved for construction materials testing services for the improvements to Miller Avenue between Maple Road and Newport Road;
 
RESOLVED, that the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, that City Council authorize the City Administrator to approve amendments to the agreement within the project budget; and
 
RESOLVED, that the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
