Resolution to Approve a Grant Contract with the Michigan Department of Transportation for Work Related to the Gates and Fencing Project at the Ann Arbor Municipal Airport and to Approve Updated Terms and Conditions of Accepting Airport Improvement Program Grants Required by the FAA ($157,895.00)

Attached for your review and approval is a resolution to approve a grant contract with the Michigan Department of Transportation-Office of Aeronautics (MDOT-Aero), including the updated Terms and Conditions of Accepting Airport Improvement Program Grants required by the Federal Aviation Administration (FAA), in the amount of $157,895.00 for the Gates and Fencing Project at the Ann Arbor Municipal Airport.
The grant amount of $157,895.00 is comprised of $150,000.00 in federal funds, $3,947.00 in state funds and $3,948.00 in airport matching funds. The airport's share of this grant is included in the airport's current operating budget. All funding (local, state and federal) for this project will come from fees paid by users of aviation industry services. The grant is administered by MDOT-Aero and they will make payments directly to the contractors for grant eligible expenses.
In 2010, the need to improve safety and security to the airfield was identified and the Gates and Fencing Project was included in the Airport Improvement Program Capital Improvement Plan for construction in FY 14. The original project included installing two automatic gates, along with fencing upgrades, in the NE T hangar area. In 2012, the airport experienced three incursions after not having any since 2009. An incursion is when a person or vehicle gets into a restricted area of the airfield. Such incursions have the potential to be serious issues from both a safety and security viewpoint. The FAA and MDOT-Aero agreed to move this project forward for immediate construction to address this issue. All parties agreed that the replacement of the existing three automatic gates, all of which are nearly 20 years old, should be included in the project.
The Terms and Conditions of Accepting Airport Improvement Program Grants is a document required by the FAA for receiving grant funding. The FAA updates this document from time to time, the last being approved by Council in March, 2012, and requires its approval as part of the grant process.
The Airport Advisory Committee has reviewed and recommended that Council approve the Gates and Fencing Project

Whereas, A need has been identified for improvements to the automatic gates and perimeter fencing at the Ann Arbor Municipal Airport and these needs were included in the airport capital improvement plan for construction in FY 14;
Whereas, Three recent incursions at the Ann Arbor Municipal Airport have made it necessary to move this project up for immediate construction;
Whereas, The Federal Aviation Administration (FAA) and the Michigan Department of Transportation - Office of Aeronautics (MDOT-Aero) have approved funding and support for the Gates and Fencing Project at the Ann Arbor Municipal Airport;
Whereas, MDOT-Aero, the Airport Advisory Committee, and City staff recommend that City Council approve the grant agreement;
Whereas, MDOT-Aero will administer the grant, including making payments for services directly to the contractor or consultant; and
Whereas, the local matching funds ($3,948.00) for this grant agreement are available in the Airport FY 13 operating budget;
RESOLVED, That the City Council approve grant contract number 2013-0100 with the Michigan Department of Transportation in the amount of $157,895.00 for work related to the Gates and Fencing Project at the Ann Arbor Municipal Airport;
RESOLVED, That the City Council also approve the Terms and Conditions of Accepting Airport Improvement Program Grants, dated April, 2012, as required by the FAA;
RESOLVED, That the Mayor and City Clerk be authorized and directed to sign said agreements upon approval as to form by the City Attorney, and upon approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be directed to take the necessary administrative actions to implement this resolution.
