Memorandum
Attached for your approval is a resolution authorizing an operational agreement between the City of Ann Arbor and Washtenaw County for the Office of Community and Economic Development (OCED). The operational agreement provides the mechanism for the continuing collaborative efforts between the City and Washtenaw County to execute the functions of the joint Office of Community Development (OCD)such as management of the City's Housing and Human Services programs, coordination of City and County human services activities and day to day functions of the OCD.
 
Approval of the operational agreement will authorize the expenditure of up to $150,000 to be paid to the Washtenaw County for FY13 operational costs to manage City's Human Services contracts, Affordable Housing Trust Fund and City-related functions of the OCD. The agreement also provides for the two City employees working in the OCED for coordination, facilitation of rehabilitation and inspections of homes and rental units occupied by lower income residents. The County will reimburse the City up to $221,000 for the expenses associated with these services provided by the two City employees in FY13.
 
The Operational Agreement has been in place since July 2010. This Operational Agreement will remain in effect through June 30, 2013 at which time the agreement may be renewed for another year.

Body
Whereas, In October 2004, the City and County created a joint Office of Community Development to operate their respective Community Development Departments;
 
Whereas, In June 2008, the City and County entered into an Urban County Cooperation Agreement covering the Community Development Block Grant Entitlement Program, HOME Investment Partnership Program and Neighborhood Stabilization Program;
 
Whereas, An Operational Agreement between the City and County provides means to deliver services that the City and County envisioned from the joint Office of Community Development;
 
Whereas, The existing Operational Agreement expired on June 30, 2012;
 
Whereas, The City and County desire to execute an Operational Agreement for the period of July 1, 2012 through June 30, 2013 with the scope of services and general conditions included in the agreement expired on June 30, 2012; and
 
Whereas, The Operational Agreement can be renewed for an additional one year term;
 
RESOLVED, That City Council approve the City of Ann Arbor and Washtenaw County Operational Agreement for the Office of Community Development;
 
RESOLVED, That City Council approve the expenditure of up to $150,000 in FY 2013, as budgeted,  for reimbursement to the County for all services provided to the City under the Operational Agreement;
 
RESOLVED, That the mayor and City Clerk be hereby authorized and directed to execute the Operational Agreement between the City and Washtenaw consistent with this resolution, subject to approval as to substance by the City Administrator and approval as to form by the City Attorney;
 
RESOLVED,  That the City Administrator be authorized to renew the Operational Agreement for an additional one year subject to the availability of funds; and
 
RESOLVED, That the City Administrator be authorized to execute on behalf of the City any action necessary to implement this resolution.
