Resolution to Approve Temporary Suspension of Funding of New Art Projects from Percent for Art Funds
Memorandum
This resolution proposes to suspend until April 1, 2013, the commitment or use of funds already set aside through the percent for art program in the FY 2013 budget and in prior years' budgets, with certain exceptions.  This would allow Council time to decide whether and how it wants to amend the Public Art Ordinance.  The exceptions would allow projects that are in process to continue to move forward.
 
Body
Whereas, City Council has appointed a committee to recommend amendments to the Chapters 8 and 24 relative to public art program, including but not limited to the percent for art program;
 
Whereas, The proposed amendment or amendments may impact the process by which public art projects are approved and administered, not only in the future but also those for which funding has already been set aside;
 
Whereas, A temporary suspension of use of the existing funding pending a decision by City Council on how it wishes to amend the City Code relative to public art will allow City Council time to determine how it wishes to amend City Code and will allow the existing funds to be used thereafter in a manner governed by the public art provisions, as amended; and
 
Whereas, Certain art projects have already progressed to the point that they should not be subject to the suspension.
 
RESOLVED, That, except as otherwise provided in this Resolution, the funding of any new art project from percent for art funds that have already been set aside in or from the FY 2013 and prior FY budgets shall be suspended until April 1, 2013;
 
RESOLVED, That this suspension shall not affect or suspend the use of funds for public art that have already been encumbered or committed by contract for a specific project;
 
RESOLVED, That this suspension shall not affect or suspend the use of funds for art for the following projects: (1) the Kingsley Street rain garden; (2) the E. Stadium Boulevard Bridges Reconstruction project; and (3) the Argo Cascades project;
 
RESOLVED; That with respect to the above three mentioned projects, AAPAC will engage in significant and robust public engagement described as follows: Directly contact appropriate local organizations, including but not limited to Homeowners Associations and Neighborhood Associations, that may be especially interested in or affected by these projects and hold two or more public forums at which interested organizations and individuals shall be provided information any may offer suggestions and opinions on the proposed art project. After each public forum, provide a report to City Council summarizing the information provided and the comments received from the public;
 
RESOLVED, That this suspension shall not remove from project funds or pooled art funds any funds for public art that have already been set aside in or from the FY 2013 and prior FY budgets through the percent for art program;
and
 
RESOLVED, That the City Administrator shall take whatever steps are required to implement this Resolution.
