Memorandum
Attached for your review and action is a resolution to approve a project agreement with The State of Michigan, Department of Natural Resources for the approved grant to renovate the Gallup Park Livery and surrounding site and to accept and appropriate up to $300,000in funding.
 
The City is required to approve the grant agreement between the City and the State of Michigan.  On March 21, 2011, the Mayor and Council adopted a resolution that approved the MNRTF grant application. The Park Advisory Commission also recommended approval of the grant application on March 15, 2011.
 
The grant provides $300,000.00 to the City of Ann Arbor to make improvements to the Gallup Park Livery and entry area at, including barrier free parking and entry improvements, trail renovations, livery building upgrades, patio renovations, new barrier free docks for kayaks and fishing, landscaping, and wayfinding signage. The terms of the grant agreement require a local match of $300,000.00. The $300,000city share was budgeted as a multi-year project as part of the approved FY2012 budget.  
 
The required resolution for the grant agreement is included in the attached resolution.

Whereas, The Michigan Department of Natural Resources approved a matching grant application for up to $300,000.00 through the Michigan Department of Natural Resources Trust Fund (MNRTF) for Gallup Park Livery and Site Renovations; and
 
Whereas, The Park Advisory Commission recommended approval of the grant application on March 15, 2011 and the Mayor and Council approved the grant application on March 21, 2011;
 
RESOLVED; That the City of Ann Arbor, Michigan, does hereby accept the terms of the Agreement as received from the Michigan Department of Natural Resources (DEPARTMENT), and that the City of Ann Arbor does specifically agree, but not by way of limitation, as follows:
 
1.       To appropriate all funds necessary to complete the project during the project period and to provide Three hundred thousand ($300,000.00) dollars to match the grant authorized by the DEPARTMENT.
 
2.       To maintain satisfactory financial accounts, documents, and records to make them available to the DEPARTMENT for auditing at reasonable times.
 
3.       To construct the project and provide such funds, services, and materials as may be necessary to satisfy the terms of said Agreement.
 
4.       To regulate the use of the facility constructed and reserved under this Agreement to assure the use thereof by the public on equal and reasonable terms.
 
5.      To comply with any and all terms of said Agreement including all terms not specifically set forth in the foregoing portions of this Resolution.
 
RESOLVED; That the Mayor and Council accept and appropriate funding not to exceed $300,000.00 from the Michigan Department of Natural Resources;
 
RESOLVED; That Mayor and City Council approve the project agreement between the City and the Michigan Department of Natural Resources for the Gallup Park Livery and Site Renovations; and
 
RESOLVED, That Mayor and City Clerk to execute the project agreement after approval as to substance by the City Administrator and to form by the City Attorney.
