Memorandum
Attached for your review and action is a resolution to approve four contracts for demolition of dangerous buildings on as-needed basis.
 
Chapter 101 of the City Code of Ordinances defines the due process to be followed for buildings that have been identified as dangerous buildings. In the past few months City staff has encountered situations where buildings were beyond repair and needed to be demolished. So far owners of such buildings have demolished buildings within the timeline stipulated by the City.  However, we will encounter situations where the property owners may not be very responsive in demolishing buildings in extreme disrepair. To address such situations expeditiously, the City staff identified the need to have contracts with preselected demolition contractors to be utilized on as-needed basis.  Said demolition work will be funded from Council established funding on February 21, 2012 for abatement of dangerous buildings. Owners of record will be invoiced for the City's costs associated with these demolitions and use all options available to recover these costs.
 
In May 2012, ITB 4224 was advertised to solicit unit price bids for demolition. Eleven companies submitted bids in response to ITB-4224. The following four companies, in the order of low to high bid, have been selected to have contracts for demolition of buildings on as-needed basis:
 
Bierlein
DMC Consultants
Beal
Van Assche
Individual work statements will be issued for each demolition project.  Performance of each contractor will be assessed for each project assigned to them and will be a determinant to continue to be on the City's list of selected demolition contractors. Timeliness, being responsive and quality of work will be key performance criteria. Non-performing contractors will be removed from this list and not awarded any future work under this program. Total expenditures per fiscal year per individual contractor will not exceed $150,000.00.

Whereas, The City has identified a need to have demolition contractors selected to be utilized on as-needed basis;
 
Whereas, Award of contracts for demolition on as-needed basis will allow the City to demolish expeditiously the buildings determined to be dangerous when owners of such buildings are non-responsive or timely;  
 
Whereas, The City issued ITB 4224 for companies to demolish buildings and associated work on as- needed basis;
 
Whereas, Eleven companies submitted unit price bids in response to ITB 4224;
 
Whereas, The following four companies have been selected to perform the type of work identified in ITB4224:
 
Bierlein
DMC Consultants
Beal
Van Assche
 
Whereas, Work performed by the said companies is to be paid from the funds established by Resolution R-12-055;
 
Whereas, Total expenditures per fiscal year per contractor is not to exceed $150,000.00; and
 
Whereas, The four companies currently have Human Rights approval and agreed to comply with the living wage ordinance;
 
RESOLVED, That City Council approve two-year contracts with Bierlein, DMC Consultants, Beal and Van Assche beginning in FY2013;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contracts after approval as to substance by the City Administrator and approval as to form by the City Attorney for an amount not to exceed $150,000.00 per company per fiscal year, and
 
RESOLVED, That the City Administrator and the City Building Official are authorized  to take all necessary actions to implement this Resolution, including the execution on behalf of the City of required demolition documents when required by applicable law or procedures.
