Memorandum
Attached for your review and approval is a resolution to award a construction contract to Doan Construction Company in the amount of $564,459.82 for the 2012 Ramp & Sidewalk Repair Project.  
 
The 2012 Ramp & Sidewalk Repair Project will consist of the repair of deficient sidewalks in approximately 20% of the City in 2012, as part of the first year of a 5-year program to perform maintenance on the City's entire sidewalk system. Other reported sidewalk deficiencies will be added to the 2012 program as needed.
 
The project also includes the continued replacement of sidewalk curb ramps to meet the requirements of the Americans with Disabilities Act (ADA).
 
The Sidewalk & Ramp Repair Project is created as a unit price contract with the understanding that the actual quantities used in construction will vary. The attached map shows the areas around the City that are currently scheduled to be included in the 2012 project. Depending on the status of the budget upon completion of work in the identified areas, the City may elect to add additional areas to the contract to take advantage of favorable pricing.
 
Project specifications were distributed electronically to contractors, subcontractors, and suppliers. Four bids were received and opened on March 30, 2012. The lowest responsible bid, in the amount of $564,459.82 is approximately $256,719.00 lower than the engineer's estimate of $821,179.00.  A tabulation of the bids is also attached.
 
Doan Construction Company received Human Rights approval on April 3, 2012. All employees of Doan Construction Company, assigned to work on the project will receive compensation in accordance with the Living Wage Ordinance.
 
The project will be funded from the Street Resurfacing & Sidewalk Repair Millage that was approved by voters in November 2012.

Whereas, The City of Ann Arbor Adopted 2011-2013 Capital Budget includes sufficient funds for the annual Ramp & Sidewalk Repair Project;
 
Whereas, The 2012 Ramp & Sidewalk Repair Project includes the repair of deficient sidewalks in approximately 20% of the City and the continued replacement of sidewalk curb ramps to meet the requirements of the Americans with Disabilities Act (ADA);
 
Whereas, The 2012 Ramp & Sidewalk Repair Project is necessary to maintain high quality pedestrian facilities in the City of Ann Arbor;
 
Whereas, Competitive bids were received by Procurement on March 30, 2012 and Doan Construction Company was the lowest responsible bidder at $564,459.82;
 
Whereas, Funding for this project is available in the approved Street Millage Fund Capital Budget;
 
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a Contract with said company for said construction project; and
 
Whereas, Doan Construction Company received Human Rights approval on April 3, 2012, and its employees will receive compensation in accordance with the Living Wage Ordinance;
 
RESOLVED, That a contract in the amount of $564,459.82 be awarded to Doan Construction Company for the construction of the 2012 Ramp & Sidewalk Repair Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
 
RESOLVED, That a contingency amount of $256,000.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Doan Construction Company, not to exceed $256,000.00 in order to satisfactorily complete this project; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
