Memorandum
Attached for your review and approval is a resolution to authorize a Professional Services Agreement with Material Testing Consultants, Inc. (MTC) for construction materials testing services in the amount of $58,420.00 for the Dexter Avenue Improvements.  
 
This project consists of the full reconstruction of Dexter Avenue from Maple Road to Huron Street, including replacement of the curb & gutter, sidewalk ramps, road base, and pavement.  It also includes the replacement and upsizing of the water main and storm sewer.
 
We received proposals from ten firms for the required construction materials testing services. Project Management staff evaluated the proposals and selected MTC based on the proposal, staff qualifications, past involvement with similar projects, and cost. MTC received Human Rights and Living Wage approval on April 6, 2012.  
 
Services to be performed include all the required testing for soils, aggregates, asphalt, and concrete.  A contract contingency amount of $5,842.00 is also requested for change orders approved by the City Administrator.  Funds for the requested services are available in the approved capital budget.

Whereas, It is necessary to retain a qualified testing firm to perform testing services for the Dexter Avenue Improvements;
 
Whereas, Proposals were received by Procurement and evaluated by Project Management staff on the basis of staff qualifications, past involvement with similar projects, proposed work plan, and cost;
 
Whereas, Material Testing Consultants, Inc. of Grand Rapids, Michigan has submitted to the City a proposal for the necessary services, setting forth the services to be performed by said firm and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, Material Testing Consultants, Inc. received Human Rights and Living Wage approval on April 6, 2012; and
 
Whereas, The required funds for the construction materials testing services are available in the approved capital budget for the Dexter Avenue Improvements Project;
 
RESOLVED, That a Professional Services Agreement with Material Testing Consultants, Inc. in the amount of $58,420.00 be approved for construction materials testing services for the Dexter Avenue Improvements Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That a contract contingency amount of $5,842.00 be established and that the City Administrator be authorized to approve change orders to the Professional Services Agreement with Material Testing Consultants, Inc., not to exceed $5,842.00 in order to satisfactorily complete this project; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
