Memorandum
Attached for your review and approval, please find a resolution to award a construction Contract to Dan's Excavating, Inc. ($2,314,951.25, Bid No. ITB-4212) for the E. Stadium Blvd. Improvement Project.
 
This construction project will include the replacement of two old water mains and resurfacing of the street from Washtenaw Ave to Packard Street. Both parts of the project are included in City's Capital Improvements Plan (TR-SC-12-07 and UT-WS-12-01).  The total project is estimated to cost $3,600,000.00, of which $1,400,000.00 will be funded via the water fund capital budget and $2,200,000.00 from the street millage approved capital budget.
 
Public Engagement Meeting
On January 12, 2012 we met with the E. Stadium Blvd residents at Tappan Middle School to present the proposed project design, construction sequence, and the temporary traffic control for the construction and to answer their questions. Twelve members of the public attended the meeting. In addition to the general comments, some members of the public asked for alternative designs, narrowing of the street and reducing the number of the traffic lanes permanently from five to four. The following paragraphs include the information that we shared with the public at the January 12 meeting and the follow up correspondence with some members of the public.
 
Water Main
There is an existing 6" water main on the south side and another 6" water main on the north side of the street. The two water mains are in poor condition and must be replaced. Those water mains are also on separate pressure districts and, therefore, must remain separated when they are replaced with new 8" water mains. The extent of the two water main replacements is from Brockman Blvd to Packard Road and together will include about 5,500 feet of new 8" mains. During the installation of the water mains two traffic lanes will be under construction and three traffic lanes will remain open to the traffic.  
 
Street Resurfacing
The pavement condition at E. Stadium Blvd is rapidly deteriorating and it is time to resurface the street. The street resurfacing presents an opportunity to review the traffic lane widths and to add bike lanes on both sides of the street. The current traffic volume at E. Stadium Blvd is at about 22,000 vehicles per day. That requires the City to maintain the current street width and the existing five lanes of vehicular traffic on the street. The street resurfacing project will also include the installation of new ADA ramps along the corridor. During this construction two or three lanes of traffic will be maintained as required by the type of construction activities.
 
Marked Pedestrian Crossing
With each new major street resurfacing or reconstruction project we study the corridors and look for ways to provide safe marked pedestrian crossing where they are needed and missing. Within the influence of the E. Stadium Blvd construction project there are signalized intersections at Packard Street and at Brockman Blvd for safe pedestrian street crossing. However there are no marked pedestrian crossing points for over 2,600 feet in the section of E. Stadium Blvd between Brockman Blvd and Packard Street. With the input from the public, we designed new marked pedestrian crosswalks with Rectangular Rapid Flash Beacons (RRFB) east of Baldwin Ave and east of Ferdon Road.
 
Construction Contract
For this construction contract we received five bids on Thursday, March 8, 2012. The low bid from Dan's Excavating, Inc. of $2,314,951.25 is approximately 11% below the Engineer's Estimate.  The construction of the project is scheduled to begin in May of 2012 and to be completed in October 2012.
 
Dan's Excavating, Inc. received Human Rights approval on March 13, 2012. The contractor's employees who will work on the project will be compensated in accordance with the City of Ann Arbor Living Wage Ordinance.

Whereas, It is time to resurface E. Stadium Blvd. from Packard Road to Washtenaw Avenue;
 
Whereas, It is necessary to replace the two existing water mains at E. Stadium Blvd. prior to resurfacing the street;
 
Whereas, The project is included in the approved Capital Improvement Plan;
 
Whereas, Funding for the project is available in the approved street millage capital budget ($2,200,000.00) and the approved water fund capital budget ($1,400,000.00);
 
Whereas, Competitive bids were received by the Procurement Unit on March 8, 2012 and Dan's Excavating, Inc. of Shelby Township, MI, was the lowest responsible bidder at $2,314,951.25;
 
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a Contract with said company for said construction project; and
 
Whereas, Dan's Excavating, Inc. received Human Rights approval on March 13, 2012 and complies with the Living Wage Ordinance;
 
RESOLVED, That a construction contract in the amount of $2,314,951.25 be awarded to Dan's Excavating, Inc, for the E. Stadium Blvd. Improvement Project, Bid No. ITB-4212;
 
RESOLVED, That a contract contingency amount of $230,000.00 be established and that the City Administrator be authorized to approve additional change orders to the construction contract with Dan's Excavating, Inc. not to exceed $230,000.00 in order to satisfactorily complete this project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
