Resolution to Release a Water Main Easement at 3600 Varsity Drive (8 Votes Required)
Memorandum
In 2011, City Council accepted a grant of easement from The Regents of the University of Michigan for a water main on the property commonly known as 3600 Varsity Drive. Due to a need for increased easement width, on December 15, 2014, the University granted and City Council accepted a new easement in the same area that was intended to supersede and replace the 2011 easement.
This release has been reviewed by the appropriate City service areas.
Release of the 2011 easement is recommended.

Whereas, In 2011, the Regents of the University of Michigan granted an easement to the City of Ann Arbor for water main infrastructure recorded in Liber 4855, Page 336, Washtenaw County Records; and
Whereas, on December 15, 2014, City Council accepted a new easement from the University of Michigan that was intended to replace this easement;
RESOLVED, That the City of Ann Arbor releases all rights conferred by the easement recorded in Liber 4855, Page 336, Washtenaw County Records.
RESOLVED, That an appropriate instrument evidencing this release and approved by the City Attorney be recorded at the Washtenaw County Register of Deeds as soon as practicable following approval of this resolution.
