Attached please find for Council action the necessary resolution to establish an industrial development district as requested by the petitioner.
State law requires that an industrial development district may be established after a public hearing by the local governing body. Establishment of an industrial development district is required prior to receipt of any applications for an industrial facilities exemption certificate within the industrial development district.

Whereas, Pursuant to Public Act 198 of 1974, as amended, the City Council has the authority to establish “Industrial Development Districts” within the City of Ann Arbor;
Whereas, This City Council desired to establish an Industrial Development District on property owned by AVL Properties, Inc. and located in the City of Ann Arbor hereinafter described;
Whereas, Written notice has been given by mail to all owners of real property located within the district, and to the public on June 28, 2009, by newspaper advertisement in the Ann Arbor News and public posting of the hearing on the establishment of the proposed district;
Whereas, earlier this evening, a public hearing was held at which all the owners of real property within the proposed Industrial Development District and all residents and taxpayers of the City of Ann Arbor were afforded an opportunity to be heard thereon; and
Whereas, City Council deems it to be in the public interest of the City of Ann Arbor to establish the Industrial Development District as proposed;
RESOLVED, That the City Council of the City of Ann Arbor hereby established as an Industrial Development District pursuant to the provisions of Public Act No. 198 of 1974, as amended, the following described...
