Resolution to Extend the Temporary Moratorium on the Use of Property and Structures in the City for Dispensing and Cultivating Marihuana

Whereas, On August 5, 2010, in Resolution #10-286, City Council imposed a temporary moratorium on the initiation or expansion of the use of property and structures in the City for dispensing and cultivating marihuana for a period of 120 days in conjunction with the study and revision of the City's Zoning Ordinance or other ordinances regarding this issue;
Whereas, The temporary moratorium was imposed for the reasons stated in the Resolution; and
Whereas, The City Council would like additional time to consider the draft revisions to the City's Zoning Ordinance, to consider a licensing ordinance for marihuana businesses, and to receive additional public comment regarding these ordinances;
RESOLVED, That City Council extend the temporary moratorium for 60 days from the original expiration date of December 3,2010 to January 31, 2011; and
RESOLVED, That the moratorium imposed by this resolution shall expire the earlier of January 31, 2011, or upon the effective date of ordinance amendments approved by City Council regarding the use of property or structures in the City for dispensing marihuana and/or cultivating marihuana plants for medical or any other purposes.
