Memorandum
Approval of this ordinance will revise the Briarwood Lots 12, 13, 14 and 15 PUD zoning district and supplemental regulations to rename the district, remove references to Lots 12 and 13 and reduce the minimum size of the district. The revisions compliment and correspond to the Briarwood Lots 12 and 13 Revised PUD zoning district and supplemental regulations, which were originally approved on September 22, 2008 and to which further revisions have been proposed and are scheduled for second reading and action on October 19, 2009.

The City Planning Commission recommended approval of the revised Briarwood Lots 14 and 15 PUD supplemental regulations on September 15, 2009.

Petition Summary:
· The Briarwood Lots 12, 13, 14 and 15 PUD zoning district and supplemental regulations were originally approved in 1996, and closely match the future land use recommendation provided in the Briarwood Subarea Plan.

· A PUD site plan for a furniture store on Lots 14 and 15 was approved in 1997. The store was subsequently constructed. A PUD site plan for a sporting goods store on Lots 12 and 13 was approved in 2005. No development occurred, and the site plan expired. A revised PUD zoning district and supplemental regulations, and a PUD site plan for two hotels on Lots 12 and 13, was approved on September 22, 2008. Further revisions to the Lots 12 and 13 supplemental regulations and the two-hotel site plan were recommended for approval by the Planning Commission on August 18, 2009 and are scheduled for City Council action at second reading on October 19, 2009.
