An Ordinance to Amend the Proposed Stormwater Code (Chapter 63) Changes to Require Stormwater Management on Single and Two-family Residential Properties when Properties Increase Impervious Area by 200 or more Square Feet (Ordinance No. ORD-10-36)
Memorandum
In August of 2007, City Council charged the Malletts Creek Coordinating Committee with prioritizing and implementing the April 2007 Watershed Recommendations of the Malletts Creek Association (resolution R-393-8-07). On June 2, 2008, the Malletts Creek Coordinating Committee communicated its priorities to City Council in the form of a revised Malletts Creek Restoration Activity Schedule spreadsheet. The top priority being regulation for stormwater management for new impervious surfaces added to single-family and two-family properties. Since then, the Malletts Creek Coordinating Committee has worked with City staff and the Water Committee of the Environmental Commission to draft amendments to Chapter 63, the Stormwater and Soil Erosion and Sedimentation Control Ordinance.
On September 24, 2009, the Environmental Commission passed a resolution recommending Council approve the amendments. A public meeting was held in November 2009 to present the proposed amendments to the public and receive feedback (summary attached).
The proposed amendments to Chapter 63 would require control of stormwater runoff from the “first flush” storm event on single and two-family residential property when adding 200 square feet or more of impervious area to the property. The “first flush” is the runoff from the first ½ inch of rain during any storm event. The new requirement would only apply to the increase in impervious area.
Because approximately 40% of the entire land area in the City of Ann Arbor is zoned for single-family and two-family uses, implementing the proposed changes to Chapter 63 will improve water quality and may reduce minor drainage issues.
