Resolution to Accept a Donation of Park Land and Access Easement at 2601 Pontiac Trail (The Cottages at Barton Green) (8 Votes Required)
Memorandum
Trinitas Development, LLC received site plan approval for an housing development at 2601 Pontiac Trail (The Cottages at Barton Green) via Consent Judgement recorded in Liber 5318, Page 487, Washtenaw County Records in City Council Resolution R-19-326. The property was subsequently deeded to MI-UM Holdings LLC, a Delaware limited liability company. After conversations with staff, MI-UM Holdings LLC proposed donating to the City an approximately 9.86 acre property adjacent to Hickory Nature Area. The donation was reviewed and recommended by the Land Acquisition Committee of the Park Advisory Commission at its November 9, 2020 meeting, conditioned upon completion of satisfactory due diligence on the property. The donation incudes an access easement to allow maintenance and pedestrian access. The proposed donation is voluntary and is not a condition of the site plan.
Staff anticipates maintaining this property as a natural area.
Upon approval of this resolution, staff will proceed with due diligence on the property, including survey, environmental assessment, and title work. If the due diligence is not satisfactory to staff and cannot be corrected, the City will not accept the property.
Budget/Fiscal Impact: The City will make use of the property owner's due diligence documentation where available. Other costs will be drawn from the Open Space and Parkland Preservation Millage proceeds as necessary.
No appraisal was obtained for this parcel because it is a donation.
