Resolution to Ratify City Administrator Approval of Emergency Purchase Order with Waste Management, Inc. for the Dexter Avenue Improvements Project ($45,000.00)
Memorandum
The attached resolution seeks ratification of the City Administrator’s authorization, pursuant to the authority granted him under Section 1:317 of the Ann Arbor City Code, for the landfilling of contaminated soil excavated from the Dexter Avenue Improvements Project.
During excavations for the Dexter Avenue road and utility work, the Contractor encountered soil which had a petroleum-type odor. We contacted the City’s environmental consultant, TetraTech, to analyze the soil and determine how to properly handle it. In addition the odor, the tests indicated that the soil was contaminated with petroleum products which require the soil to be landfilled.
Soil borings taken before the project did not find any indication of this tainted soil. While we have no evidence, we assume that the soil was contaminated by an old automobile repair shop that used to be near the site.
Between the two local eligible landfills (EQ and Waste Management), Waste Management had the lower tipping fees. At the time of this memo, the Contractor had already excavated approximately 3000 tons of soil and we estimate that there will be approximately 1200 tons once we begin excavations on the north side of the road. The tipping fee is $9.98/ton.
The City Administrator authorized the request on October 24, 2012, having been fully apprised of the urgency of this request. A copy of October 31, 2012, memorandum to City Council, with a copy of his approval attached, is attached.
We propose to fund this purchase order from the existing budget of the Dexter Avenue Improvements Project.
