Memorandum
There is a resolution before you to accept an easement for public storm water from Richard P. Scherer and Patricia A. Scherer, husband and wife. The easement is for the construction and maintenance of a public storm water pipe that allows the storm water to flow into and out of Harvard Place.
The Public Services Area has reviewed the easement and has no objections.
The easement is in standard form and conveyed without cost to the City.
Acceptance of the easement is recommended.

Whereas, Richard P. Scherer and Patricia A. Scherer, husband and wife, are the owner sin fee simple of property located in the City of Ann Arbor, Washtenaw County, Michigan as described in the Washtenaw County Records at Liber 1401, Page 297, recorded June 26, 1972; and
Whereas, Richard P. Scherer and Patricia A. Scherer, husband and wife, have delivered an easement to the City for the construction and maintenance of a storm water pipe to run with the land and burden the respective property perpetually, being more particularly described as follows:
Description of Easement:
A variable width easement for storm sewer, being part of the SE ¼ of Section 28, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan. More particularly described as:
Commencing at the NE Corner of said Lot 8, James H. McDonald’s Subdivision, as recorded in Liber 5 of Plats, Page 43, Washtenaw County Records; thence S05º 45’ 00” W 39.40 feet along the Easterly line of said Lot 8; thence 2.61 feet along a curve to the left having a radius of 50.00 feet; delta 01º 59’ 31”, a chord bears N85º 44’ 44” W 2.61 feet along the Northerly line of Harvard Place (variable width); thence N02º 09’ 48” W 39.0...
