Resolution to Approve a Contract with Margolis Companies for Improvements at Beckley and Winewood Thaler Parks ($152,000.00)
Memorandum
Attached for your review and action is a resolution to approve a $152,000.00 contract with Margolis Companies and a $15,200.00 (10%) construction contingency for improvements at Beckley and Winewood Thaler Parks.
 
Both neighborhood parks have play areas with equipment that no longer complies with Consumer Product Safety Guidelines and the pathways in both parks are cracked and deteriorated. The improvements will include replacement of all the pathways and sidewalks and new playground equipment at both parks, replacement of a half basketball court at Winewood Thaler Park, and construction of a new bocce ball court at Beckley Park. The severely deteriorated pathway through Fairview Cemetery connecting Beckley Park to Wright Street will also be replaced as a part of this project.
 
Public meetings were held for the project, and a neighborhood survey was sent to every resident within ΒΌ mile of the parks. The improvements are a result of the input gathered from the residents. Both parks are identified in the PROS plan as needing improvements in FY2012.
 
The following two bids were received in response to ITB 4174:
 
Margolis Companies      $147,654.00
Erie Construction LLC      $275,983.25
 
Subsequently State law was enacted prohibiting CUB Agreements as a term of construction contracts and minimal additional elements to the scope of work were identified (replacing asphalt with concrete for the sidewalks at Winewood Thaler Park to better facilitate barrier free sidewalk grades, and having the contractor take delivery of the playground equipment.) increasing the overall scope of work.   Both bidders were requested to provide a "Last Best Offer" as a result of these changes which resulted in final bids of:  
 
Margolis Companies             $152, 000.00
Erie Construction LLC     $248,983.00
 
Staff recommends accepting Margolis Companies' offer of $152,000.00 as the lowest responsible bid and Council approve a contract with Margolis Companies in the amount of $152,000.00 for improvements at Beckley and Winewood Thaler Parks.
 
You are also requested to approve a 10% construction contingency in the amount of $15,200.00 to cover potential contract change orders to be approved by the City Administrator and $167,200.00 be approved for the life of the project without regard to fiscal year. Funding is available in the approved FY2012 Park Maintenance and Capital Improvements Millage.
 
Margolis Companies meets the living wage and prevailing wage requirements and received Human Rights approval on July 22, 2011.

Whereas, Competitive bids were received by Procurement Services on July 20, 2011;
 
Whereas, Margolis Companies submitted the lowest responsive bid in the amount of $152,000.00 for improvements at Beckley and Winewood Thaler parks;
 
Whereas, Margolis Companies received Human Rights approval on July 22, 2011; and
 
Whereas, Funding for the project is available in the approved FY 2012 Park Maintenance and Capital Improvements Millage;
 
RESOLVED, That City Council approve a contract with Margolis Companies in the amount of $152,000.00 for improvements at Beckley and Winewood Thaler Parks;
 
RESOLVED, That City Council approve a construction contingency of $15,200.00 (10%) to cover potential contract change orders to be approved by the City Administrator;
 
RESOLVED, That $167,200.00 be funded from the FY2012 Parks Maintenance and Capital Improvements Millage available for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
