Memorandum

The attached resolution authorizes the summary publication of the ordinance amendment adding Section 9:42 to Chapter 107 (Animals) and amending Sections 9:38, 9:45, and 9:52 of Chapter 107 (Animals). This ordinance amendment allows the keeping of a maximum of four chickens on property used principally for single or two family residential purposes pursuant to a permit and in compliance with certain other requirements.  The ordinance also amend the definition of a “noise nuisance” to include animal noises audible beyond a property line between 10:00 p.m. and 7:00 a.m

 

The City Charter contains provisions to allow summary publications of ordinances that are in excess of 500 words in length.  The purpose of this resolution is to lessen the City's cost resulting from the required publication of the ordinance revisions.

Whereas, Section 7.4 of the City Charter authorizes the publication by summary of ordinances over 500 words in length;

 

RESOLVED, That the publication of Ordinance ORD-08-19 shall be by the following summary:

 

Ordinance ORD-08-19 adds a new Section 9:42 to and amends Sections 9:38, 9:45, and 9:52 of Chapter 107 (Animals), which allow the keeping of a maximum of four chickens (hens, only) in the backyard of property used principally for single or two family residential purposes pursuant to a permit and in compliance with certain requirements that include, but are not limited to procuring the consent of owners of all the adjacent properties.  The ordinance further provides that private use restrictions remain enforceable and take precedence over a permit.  The ordinance further provides that a “noise nuisance” includes animal noises audible beyond a property line between 10:00 p.m. and 7:00 a.m.
