Memorandum
Attached for your review and action is a resolution to approve a construction contract in the amount of $135,832.58 and establish a total construction budget of $149,415.58 as identified in Bid #3892 for Bandemer Park Site Renovations.  Site renovations will include parking improvements, landscaping, storm water detention and construction of a dirt bike jump course.  Funds for this project are in the FY 08 Bandemer Property Fund.
 
The 2000 - 2005 Parks and Recreation Open Space Plan identified Bandemer Park for updates and improvements in fiscal year 2005-2006.  The Bandemer property was purchased with funding from a Natural Resources Trust Fund Grant in 1993.  Under the terms of the purchase agreement, the existing industrial tenants have paid rent to the City and have continued to operate on the southern portion of the property for the duration of their lease agreements.  The lease payments have been paid to the Bandemer Property Fund and the Bandemer Property Fund will be used to make the proposed park improvements at the Bandemer Park site.  The northern portion of the property was renovated in phases during the 1990's.  A Recreation Bond Grant helped to fund these various improvements including a picnic shelter, parking, trails, docks and a pedestrian bridge.  In 2003, a Transportation Enhancement Grant helped to fund a non-motorized path that connects the northern and southern portions of the park.
 
As the tenants' leases have expired and tenants have vacated the site, portions of the southern property have become accessible.  Limited restoration work has been completed including removal of fencing and concrete slabs, demolition of structures, removal of unused electrical service, and abandonment of obsolete monitoring wells, which were removed because testing is no longer needed at the site.  The property is now available for improvement.
 
Three public meetings and numerous user group meetings were conducted to obtain community input for park improvements.  The addition of native landscaping, reconfiguration of the parking areas to provide increased safety, efficient use of space, improvement of the appearance of the park, construction of a dirt bike jump course, and storm water detention to improve water quality were identified as priority improvements at the site.
 
The Park Advisory Commission recommended approval of the Bandemer Park Master Plan at their June 19, 2007 meeting.  Other improvements included in the master plan for Bandemer Park, that are being completed under separate contracts, include paving of parking areas, construction of a disc golf course, and the addition of a picnic shelter and restroom.
 
Bid documents were advertised on MITN BidNet and distributed to local contractors.  Six contractors submitted bids on the project as follows:

Greg Davis Landscape bid was non-responsive in that it did not meet the required specifications.  The Future Fence bid was incomplete.  Cameron Contracting is the lowest responsible bid.
 
The resolution includes a recommended construction contingency of $13,583.00 (10%) to cover potential contract change orders to be approved by the City Administrator.  It is requested that a total construction project budget be established of $149,415.58 for the life of the project without regard to fiscal year.
 
Cameron Contracting, Inc. meets the living wage and prevailing wage requirements and received Human Rights approval on August 8, 2007.

Whereas, Competitive bids were sought by the Procurement Office with bids received on August 29, 2007 and Cameron Contracting was identified as the lowest responsible bidder;
 
Whereas, Funds for the project are included in the FY 08 Bandemer Property Fund; and
 
Whereas, Cameron Contracting received Human Rights approval on August 8, 2007 and complies with the living wage and prevailing wage requirements;
 
RESOLVED, That City Council approve a construction contract, per bid #3892, with Cameron Contracting in the amount of $135,832.58 for improvements to Bandemer Park;
 
RESOLVED, That City Council approve a construction contingency in the amount of $13,582.00 (10%) to cover potential contract change orders for a total project budget of $149,415.58 for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
