Resolution to Approve a Contract with the Michigan Department of Transportation for the Fuller Court Sidewalk Gap Project ($147,019.00)

Attached for your review and consideration, please find a resolution to approve a contract with the Michigan Department of Transportation (MDOT) for the construction phase of the Fuller Court Sidewalk Gap Project. The agreement prescribes the cost sharing of the construction, as well as each party’s rights and responsibilities, and is required for the project to receive federal funding from the Surface Transportation Program (STP).
This project includes the installation of new sidewalk along the southwest side of Fuller Court in front of 2200 and 2230 Fuller Court. Construction is expected to begin on or after April 1, 2021 and be completed by July 31, 2021, with the exception of watering and cultivating in 2021 during the growing seasons. The original scope of this project included a portion of sidewalk adjacent to the University of Michigan property at the corner of Fuller Road and Fuller Court, which would have allowed for the sidewalk to be connected to Fuller Road. As a result of the COVID-19 pandemic, the University of Michigan has withdrawn their commitment to fund this portion of the sidewalk and therefore the City has put that segment on hold. Construction of this segment of the sidewalk will be considered for a future date in coordination with the University of Michigan.
For the remainder of the Fuller Court sidewalk, the City submitted final plans to MDOT in June of 2020, and the project was advertised in July for a September 4, 2020 bid letting through MDOT. This memorandum and resolution were prepared prior to the letting date, therefore bids were not yet available. MDOT will award a contract to the qualified low bidder and administer the contract. The City or its representative will act as the project engineer.
Budget/Fiscal Impact: The Engineer’s estimate for the project’s construction is $187,340.00. The estimated total cost of the project is $262,276.00. In total, the City will be receiving approximately $147,019.00 in STP funds for this project. The federal funding will be used to fund participating construction expenses. The City will be funding the local share of the construction costs and the design, construction engineering, and material testing costs. Funding for this project will also include special assessments. A breakdown of the project revenues is shown below:

Whereas, Funding for this project will be paid by Special Assessment and the Street, Bridge, and Sidewalk Millage;
Whereas, The City of Ann Arbor will receive Surface Transportation Program funding; and
Whereas, It is necessary to approve the cost sharing agreement with the Michigan Department of Transportation so that the project can proceed;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute Michigan Department of Transportation Contract No. 20-5355 for the Fuller Court Sidewalk Gap Project, substantially in the form on file with the City Clerk, following approval as to substance by the City Administrator, and approval as to form by the City Attorney; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
