Memorandum
Attached for your review and action is a resolution to approve the amendment of the current contract with Earth Tech, Inc., for the provision of environmental consulting services in conjunction with the Broadway Village at Lowertown development project.
On May 7, 2007, the City entered into a contract with Earth Tech, Inc., to provide environmental services in conjunction with the Broadway Village at Lowertown development project. At the time of entering into the contract, it was anticipated that the length of service would be short-term and that less than $25,000 would be required. Subsequently, it has been determined that additional services are necessary resulting in the need to contract for more than $25,000 requiring City Council authorization.
We have reached a point in the review of this project where it has become necessary to provide additional services beyond what was originally considered in order to continue an appropriate level of environmental review on this project. As with other professional services associated with this project, the developer is paying the cost for the services and there will be no cost to the City.

Whereas, On May 7, 2007, the City approved a service agreement with Earth Tech, Inc. to provide environmental services in conjunction with the Broadway Village at Lowertown Development Project;
Whereas, It has become necessary to continue that service agreement and allocate additional funds in order to perform environmental review associated with the Broadway Village at Lowertown Development Project;
Whereas, Continuation of the contract will allow the City to effectively review proposed environmental clean up measures and monitor the effectiveness of the cleanup as it occurs;
Whereas, Costs for all services associated with this agreement are reimbursed by the developer in accordance with the Development Agreement for the project; and
Whereas, Earth Tech, Inc. received Human Rights approval on October 8, 2007;
RESOLVED, That City Council approve an appropriation to the revenue budget for $49,662 for environmental review services to be paid for by the developer;
RESOLVED, That City Council approve an increase in the revenue and expenditures budget in the General Fund Planning and Development Services budget in the amount of $49,662 with source of funds from the developer;
RESOLVED, That City Council approve Amendment No. 1 to the contract with Earth Tech, Inc. for an additional amount of $49,662 for the provision of environmental review services; and
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract document after approval as to substance by the City Administrator and approval as to form by the City Attorney.
