Resolution to Approve a Professional Services Agreement with CTI and Associates, Incorporated for Material Testing Services for the Southside Interceptor Sanitary Diversion Project ($25,430.00)

Attached for your approval, please find a resolution to approve a Professional Services Agreement (PSA) with CTI and Associates, Incorporated (CTI) in the amount of $25,430.00 for material testing services for the subject project.
In January of 2018, the City received six proposals for material testing services during the 2018 and 2019 construction season in response to RFP No. 18-02. A selection committee reviewed the proposals and determined which firms were most qualified according to the following scoring criteria:
• Professional Qualifications (15%)
• Proposed Work Plan (25%)
• Past Performance (40%)
• Fee Proposal (20%)
The committee ranked the firms in the following order:
1. Materials Testing Consultants
2. Professional Services Industries
3. Testing Engineers & Consultants
4. CTI
5. TTL Associates
6. Tyme Consulting Engineering
The committee decided that the top five firms were qualified and thus, projects for the 2018 and 2019 construction season were divided between them, with CTI selected for the Southside Interceptor Sanitary Diversion Project.
Engineering staff negotiated the scope of work and associated fee for this project, which is reflected in the attached PSA. CTI received Non-discrimination and Living Wage approval on March 4, 2019. The form of contract will be the standard professional services agreement drafted by the City Attorney.
Budget and Fiscal Impact: Funding for this work is included in the Southside Interceptor Sanitary Diversion Project.
A contingency fund for this project to cover any needed amendments to this agreement has been created with the resolution to award the construction contract to M-K Construction Company, Incorporated which is being presented to Council for their approval on April 15, 2019.

Whereas, It is necessary to retain the services of a professional material testing firm to perform the needed material testing and inspection services for the Southside Interceptor Sanitary Diversion Project;
Whereas, The professional engineering firm of CTI and Associates, Inc. (CTI) has submitted to the City a proposal for the necessary services, setting forth the services to be performed by said firm, and the payments to be made by the City therefor, all of which are agreeable to the City;
Whereas, Funding for this work is included in the Southside Interceptor Sanitary Diversion project budget; and
Whereas, CTI received Non-discrimination and Living Wage approval on March 4, 2019;
RESOLVED, That a professional services agreement be approved with CTI in the amount of $25,430.00;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement, after approval as to form by the City Attorney and approval as to substance by the City Administrator;
RESOLVED, That the City Administrator be authorized to approve amendments to this professional services agreement within the project budget in order to satisfactorily complete the project; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
