Memorandum
Attached for your approval is a resolution to authorize the award of a construction contract to Fonson Company, Inc. for $853,846.00 for the construction of a shared use asphalt path and other related work associated with the W.R. Wheeler (Swift Run) Service Center PUD Non-motorized Improvements - Phase 2 Project.
The Phase 2 project involves construction of a new 10-foot wide and approximately 2500-foot long shared use asphalt path on the east side of Stone School Road that will extend the existing path fronting the Wheeler Service Center property southerly to Morgan Road. This new path will fill the gap between the existing path, which the project will rehabilitate, and the timber boardwalk constructed during the Phase 1 project. Phase 2 improvements together with those completed during Phase 1 will fulfill the City’s pedestrian connectivity obligations identified in the approved, as amended, Planned Unit Development (PUD) Final Site Plan for the City of Ann Arbor Swift Run Service Center Area Plan (RZ 04-01).
In addition to fulfillment of PUD requirements, staff believes that these non-motorized improvements will better serve the current transportation and recreation needs in the area.
Budget/Fiscal Impact: The current City of Ann Arbor Capital Improvements Plan (CIP) includes the W.R. Wheeler (Swift Run) Service Center PUD Non-motorized Improvements (CIP ID/Name: TR-AT-16-02/Wheeler Center Area Sidewalks). Total project costs of $1,135,000.00, which include a construction contingency, project management and contract administration, construction engineering, inspection, construction materials testing, equipment rental, and miscellaneous expenses, are available in the Maintenance Facility Capital Projects Fund (#0004).
Upon completion of the work and final closure of the project, the remaining funds will be refunded to participating Funds, which include the General Fund, Fleet Services Fund, Water Supply System Fund, Sewage Disposal System Fund, Solid Waste Fund, Major Street Fund, and the Local Street Fund.
Public Outreach
Staff engaged with property owners adjacent to this project throughout the design process, and met with them on-site to discuss impacts to the adjacent right-of-way. Staff also worked with Pittsfield Township and adjacent property owners to accommodate certain requests to the extent they were feasible and realistic.
Adjacent residents and property owners will receive notification prior to the start of work and at various project milestones to keep them informed as construction progresses.
Bidding
The City advertised the proposed work for bid on its purchasing webpage and on the Michigan Inter-governmental Trade Network (MITN) website with the bid documents being available to interested contractors. The City received and opened 2 bids on Tuesday, April 2, 2019. The City considered one of the bidders to be non-responsive and rejected its bid due to the omission of a required form. The lowest responsible bid, $853,846.00, is approximately 5.9% higher than the Engineer's Estimate of $806,260.36. Attached for reference is a tabulation of the bids.

Whereas, The approved Planned Unit Development (PUD) Final Site Plan for the City of Ann Arbor Swift Run Service Center Area Plan (RZ 04-01) specifies that pedestrian connectivity requirements be fulfilled;
Whereas, The Pittsfield Charter Township Planning Commission granted the City an extension and amendment to the PUD requirements at their meeting on November 5, 2015;
Whereas, The Phase 2 project satisfies the PUD non-motorized requirements for construction of sidewalks and paths;
Whereas, The non-motorized improvements will better serve the current transportation and recreation needs in the area;
Whereas, Upon completion of this phase the Maintenance Facility Construction project will be completed and the Fund can be closed;
Whereas, The City’s Procurement Office received competitive bids on Tuesday, April 2, 2019, and Fonson Company, Inc. was the lowest responsible bidder at $853,846.00;
Whereas, The contract proposal sets forth the services to be performed by said company, and the payments to be made by the City therefor, all of which are agreeable to the City;
Whereas, It is now necessary to enter into a contract with said company for this construction project; and
Whereas, Fonson Company, Inc. complies with the City of Ann Arbor Non-Discrimination and Living Wage Ordinances;
RESOLVED, That a contract in the amount of $853,846.00 be awarded to Fonson Company, Inc. for the construction of the W.R. Wheeler (Swift Run) Service Center PUD Non-motorized Improvements - Phase 2 Project;
RESOLVED, That $1,285,227.00 be appropriated from the Maintenance Facility Capital Projects Fund; thereby, increasing the revenue and expenditure budgets of the existing Maintenance Facility Construction project budget;
RESOLVED, That upon final project closure, remaining funds will be refunded to the participating funds, which includes the General Fund, Fleet Services Fund, Water Supply Fund, Sewage Disposal System Fund, Solid Water Fund, Major Street Fund, and the Local Street Fund;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator;
RESOLVED, That a contingency amount of $85,400.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders/contract modifications to the construction contract with Fonson Company, Inc., not to exceed $85,400.00 in order to satisfactorily complete this project; and
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution.
