Resolution to Approve a Construction Contract with Doan Construction Co. for the Ellsworth Road Sidewalk Gap Elimination Project, RFP No. 22-49 ($639,726.00)

Attached for your review and approval is a resolution to approve a construction contract with Doan Construction Co. (“Doan”) in the amount of $639,726.00 for the Ellsworth Road Sidewalk Gap Elimination Project (RFP No. 22-49).
Guided by the existing sidewalk gap prioritization and capital planning processes, the project consists of installing new sidewalk on the north side of Ellsworth Road, between State Street and Stone School Road, utilizing County Road Millage funding and funding from the Sidewalk Construction Millage that voters approved on November 3, 2020.
Engineering staff created the plans and contract documents and bid the project through the City’s Purchasing Unit. On July 19, 2022, two proposals were received for this work. A selection committee comprised of Engineering staff reviewed the proposal and determined the which bidder was the best value based on the criteria provided in ORD-21-41, adopted by Council on January 3, 2022:

• Workplace Safety (20%)
• Workforce Development (20%)
• Social Equity & Sustainability (20%)
• Schedule of Pricing/Cost (20%)
After reviewing and scoring the proposals, staff ranked the responding firms in the following order:
1. Doan Construction Company $ 639,726.00
2. E.T. MacKenzie Company $1,097,650.00
Doan received the higher score among the proposals reviewed by the selection committee. Therefore, staff recommends awarding the contract for this project to Doan Construction Company.
Doan complies with the City’s Non-Discrimination and Living Wage ordinances as well.
Budget/Fiscal Impact: This project is included in the FY22-27 Capital Improvements Plan (TR-AT-18-09). The anticipated total cost of the project is $900,000.00. Funding for the project is included in the approved Sidewalk Construction Millage Fund Capital Budget.

Approximately 3,900 linear feet (0.74 miles) of new sidewalk is being added to the City’s 438 miles of existing sidewalk. The anticipated additional maintenance costs are negligible.

Whereas, The Sidewalk Construction Millage was approved by voters on November 3, 2020 and will provide funding for the sidewalk gap filling work without the need to specially assess.
Whereas, The Ellsworth Road Sidewalk Gap location was selected by utilizing a staff-developed prioritization system and capital planning processes.
Whereas, Funding is available in the approved Sidewalk Construction Millage Fund Capital Budget;
Whereas, The City of Ann Arbor received two proposals for this work on July 19, 2022 and Doan Construction Company received the highest score among the proposals reviewed by the selection committee; and
Whereas, It is now necessary to enter into a contract with Doan Construction Co. for the project construction;
RESOLVED, That City Council approve a construction contract with Doan Construction Co. in the amount of $639,726.00 for the construction of the Ellsworth Road Sidewalk Gap Elimination Project (RFP No. 22-49);
RESOLVED, That a contingency amount of $64,000.00 be established within the project budget and that the City Administrator be authorized to approve change orders not to exceed that amount;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
