Memorandum
There is a resolution before you to approve a grant of easement for road right-of-way to the Board of County Road Commissioners of the County of Washtenaw in connection with the reconstruction of the Speedway gas station located at the southeast corner of the Ellsworth and S. State Street intersection.
 
The proposed dedication is for additional road right-of-way on St. State Street in order to comply with the Washtenaw County Road Commission's requirements in connection with road improvements made by Speedway SuperAmerica, LLC.   The easement area is designed to accommodate the specific road improvements and minimize the impact on the airport's land.
 
The Airport Manager and the Airport Advisory Committee reviewed and approved the proposed road dedication and found that the grant of easement to the Washtenaw County Road Commission would not impact the current or future operations of the airport.  
 
Approval of the grant of easement for additional road right-of-way is recommended.

Whereas, The Washtenaw County Road Commission has requested an easement from the City of Ann Arbor for road right-of-way over a portion of South State Street adjacent to the Ann Arbor Airport in connection with the redevelopment of the existing Speedway gas station; and
 
Whereas, City staff have determined that the request of the Washtenaw County Road Commission for additional road right-of-way is reasonable and that the terms and conditions of the easement will not interfere with City airport operations;
 
RESOLVED, That the City of Ann Arbor approve the granting of an easement for additional road right-of-way to the Washtenaw County Road Commission over a portion of South State Street adjacent to the Ann Arbor Airport, described more particularly as follows:
 
Legal Description for additional 15 feet:
 
Being a parcel of land in the NW Quarter of the NW Quarter of Section 16, T3S, R6E
in Pittsfield Township, Washtenaw County, Michigan, bounded and described as follows:
 
Commencing at an iron pipe found at the NW Corner of Section 16 as per LCRC, Liber 4, Page 277, Washtenaw County Records, said point also being at the intersection of the centerlines of Ellsworth Road, so called, and South State Street, so called.
 
Thence S 20º 07' 33" E along the centerline of South State Street, a distance of 576.88
feet to a set mag nail.
 
Thence N 87º 53' 16" E, a distance of 34.70 feet to a set bar on the E right-of-way of South State Street, said point also being the true Point of Beginning.
 
Thence continuing N 87º 53' 16" E, a distance of 15.77 feet to a set bar.
 
Thence S 20º 07' 33" E, a distance of 125.00 feet to a set bar.
Thence S 87º 53' 16" W, a distance of 15.77 feet to a set bar on the E right-of-way of South State Street.
 
Thence N 20º 07' 33" W, along the E right-of-way of South State Street, a distance of 125.00 feet to the true Point of Beginning.
 
Containing 1,874.63 Square feet or 0.043 acres of land.  Bearings used herein are based upon an assumed meridian and are intended to indicate angular measurement only.  All bar set are 30" X 5/8" steel bars with a cap marked "Bryan D. Ellis RLS 54051".  This legal description is based upon a field survey prepared by Lewandowski Engineers of Michigan on December 22, 2009.
