Memorandum
Attached for your review and action is a resolution to approve a $28,542.00 contract with D & J Contracting, Inc., and a $2,845.00 (10%) construction contingency to cover potential contract change orders for a total project budget of $31,297.00 to provide barrier free access to the Buhr Park Pool and Ice Arena per Bid # 4069.
 
The existing entrance to Buhr Park Pool and Ice Arena was constructed before  current Americans with Disabilities Act requirements for access became effective.  Currently, patrons who require a ramp for access must use the existing vehicle service drive.  This drive is located at the far end of the parking lot, increasing the distance to the entrance and separating user groups.  The proposed improvements, which will bring the access in compliance with current ADA requirements,  include a sloped sidewalk in close proximity to the entrance that will accommodate all users.  Funding for the project is included in the approved FY 10 Park Rehabilitation and Development Millage, Fund 0018.
 
Bid documents were advertised on MITN and on the City of Ann Arbor website.  Nine companies submitted bids for the project as follows:

The resolution includes a recommended construction contingency of $2,845.00 (10%) to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $31,297.00 total construction project budget be established for the life of the project without regard to fiscal year.
 
D & J Contracting, Incorporated meets the living wage and prevailing wage requirements and received Human Rights approval on February 24, 2009.

Whereas, Renovations to the existing entrance to Buhr Park Pool and Ice Arena have been identified that would improve access and conform to current requirements of the Americans with Disabilities Act (ADA);
 
Whereas, This project features a sloping sidewalk at the main entrance to the complex that will provide barrier free access;
 
Whereas, Of the nine bids received in response to Bid No. 4069, D & J Contracting, Inc. submitted the lowest responsible bid in the amount of $28,452.00;
 
Whereas, D & J Contracting, Inc. received Human Rights approval on February 24, 2009 and complies with the living wage and prevailing wage requirements; and
 
Whereas, Funding for the project is available in the approved FY 2010 Park Rehabilitation and Development Millage;
 
RESOLVED, That City Council approve a construction contract, per Bid #4069, with D & J Contracting, Inc. for $28,452.00 and approve a construction contingency of $2,845.00 (10%) to cover potential contract change orders for a total project budget of $31,297.00 to provide barrier free access to the Buhr Park Pool and Ice Arena for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
