Memorandum
Attached please find a resolution that will authorize the City Administrator to enter into an agreement with DTE Energy (DTE) to relocate existing sub-transmission and distribution power lines pursuant to the East Stadium Boulevard Bridges Replacement Project.  The estimated cost of the agreement at this time is $302,944.00.
 
In order to replace the E. Stadium Boulevard Bridge over the Ann Arbor Railroad tracks it is necessary to temporarily relocate existing DTE power lines underground in order to allow for safe demolition and construction of the new bridge.  Once the bridge has been reconstructed, DTE will replace the lines above ground in a location that will allow DTE to restore their needed system capacity and integrity.
 
There are two power poles tapped to the overhead distribution circuit adjacent to the railroad which feed underground services west along E. Stadium Boulevard; these power lines must be relocated due to the footprint of the new bridge. This relocation will require the re-routing of cables, and may require the installation of a primary switch cabinet. A switch cabinet cannot be installed without an easement. A cost estimate for this portion of the work cannot be determined until the need and possible location of switch cabinet and routing of the cables is determined by DTE.  As a result, we expect the final cost of the agreement to be more than the currently estimated amount.
 
Ordinarily, we would come before you with the final agreement for your approval; however, it will take several months to finalize the cable relocation route, design the conduit run, estimate the cost, and negotiate the final agreement.  Unfortunately, we cannot wait to complete these tasks as we will not be able to meet the schedule that we developed and presented to you on August 17, 2009 (copy attached.)  To facilitate the project's schedule we are requesting that you authorize the City Administrator to sign the agreement once all elements of it have been satisfactorily negotiated by DTE and Staff so that the work can begin immediately.  Later we will present the City Council with another resolution to retroactively approve the City-DTE Energy Agreement.  Once the agreement has been finalized, we will present it to you along with its final amount and a resolution to approve the final agreement.
 
Funding for this work will come from the approved the Street Reconstruction Millage Capital Budget and will these expenditures will become part of the total project cost.
 
The agreement between the City and DTE will be in a form as approved by the City Attorney and approved as to substance by the Public Services Area Administrator and the City Administrator.  We expect to come before you by the end of 2009 with the final agreement.

Whereas, It is necessary to temporarily relocate DTE Energy power lines so that the E. Stadium Boulevard Bridge over the Ann Arbor Railroad tracks can be safely removed and replaced;
 
Whereas, The project schedule does not allow for the agreement between DTE Energy, Inc. and the City of Ann Arbor to be finalized and presented for Council's review and approval without adversely impacting the project's schedule; and
 
Whereas, The Public Services Area Staff will bring the final agreement and its costs therefore to City Council at a later date for their review and approval.
 
RESOLVED, That Council authorize the City Administrator to enter into an agreement not to exceed $340,000.00 with DTE Energy, Inc. for the needed relocation of power lines and appurtenances so that the E. Stadium Bridge Replacement Project can proceed without delay;
 
RESOLVED, That the final agreement and its costs therefore will be brought before City Council at a later date for their review and approval;
 
RESOLVED, That the funding for the work will come from the approved Street Repair Millage Capital Budget;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the Public Services Area Administrator and the City Administrator; and
 
RESOLVED, The City Administrator be authorized and directed to take the necessary administrative actions to implement this resolution.
