Memorandum
Attached for your approval is a change order to the Construction Contract with Fonson Company, Inc. (“Fonson”) (Bid No. 4519) for the North Fifth Avenue Reconstruction Project.
The Project includes complete road reconstruction, new sidewalks, streetlighting, and extensive streetscaping, stormwater improvements, and water main replacement. Work commenced in spring 2018, and continued until weather forced a winter shutdown. Work resumed in May 2019 and is scheduled to be complete in July.
Budget Impact: The project is funded by a combination of DDA and City funding sources. The construction contract was approved by City Council in 2018 for a total authorized amount of $3,681,257.90. Previously authorized Change Order No. 1 $667,999.97, and this second change order for $428,000.03, increase the total authorized amount to $4,777,257.90.

The additional work funded by the DDA was authorized by DDA staff for improvements at Community High School, as well as changes to the streetscaping and landscaping in the right of way.
Primary additional road work items include milling and paving of Fifth Avenue from Ann St. to Catherine St, and from Kingsley St. to Beakes St, repaving Kingsley St from Fourth Ave. to Fifth Ave, and replacing pavement subbase to support the new road pavement.
Additional storm sewer was added to the project on Kingsley Street from Fourth Avenue to Fifth Avenue when utility work during the project revealed that the existing storm sewer was undersized and inadequate.
The change order also includes balancing the contract to reflect actual as-constructed items and quantities.
Fonson complies with the City’s Non-Discrimination and Living Wage Ordinances.

Whereas, The City-adopted Capital Budget includes the Fifth Avenue Reconstruction, and funding for the project is available in respective funds;
Whereas, Fonson Company, Inc. (“Fonson”) was awarded the contract for the Fifth Avenue Reconstruction for a bid amount of $3,681,257.90, plus a contingency of $668,000, for a total authorized amount of $4,349,257.90;
Whereas, $510,000.00 of Change Order #1 & Change Order #2 are associated with work being completed on behalf of the Downtown Development Authority; and
Whereas, Fonson complies with the City’s Non-Discrimination and Living Wage Ordinances;
RESOLVED, That Change Order No. 2 to the construction contract with Fonson for the Fifth Avenue Reconstruction Project be approved in the amount of $428,000.03 for additional amounts of work under the contract;
RESOLVED, That the $510,000.00, the amount contributed by the Downtown Development Authority, be appropriated to the existing North Fifth Avenue Reconstruction project budget; thereby, increasing the project’s revenue and expenditure budgets; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
