Memorandum
The City of Ann Arbor owns approximately the western 1/3 of the Arboretum. The irregularly shaped parcel includes more than ½ of the south bank of the Huron River as it flows through the Arboretum.
 
Along the south bank of the Arboretum is a road used both by the City of Ann Arbor and the University.   The road provides access to the park.  The City uses the road to access, clean and maintain a trunk sanitary sewer which parallels the river.  Without this road, maintenance of the sanitary sewer would be virtually impossible, which would be very problematic given the sanitary sewer's close proximity to the river.  Additionally, the road provides access to watermains and fire hydrants in the Arboretum.  The road is the only access for safety services for the caretaker's structure within the Arboretum.  
 
On the city owned property, the road has failed and a portion was sliding down toward the Huron River.  Temporary repairs have been completed to stabilize the road.  The University of Michigan has taken the lead in designing, bidding, contracting and managing a project to replace the road and to stabilize the south bank of the Huron River.
 
The repair to the road and stabilization of the river bank are currently underway.  The attached resolution will authorize a purchase order to the University of Michigan to pay for 50% of the project. The City's share of the project will be allocated to the Sewage Disposal Fund (25%), Water Supply System Fund (25%) and to the Park Rehabilitation and Development Millage Fund (50%).
 
Funding is available in FY08 Sewage Disposal System and FY08 Water Supply System Operations and Maintenance budgets and in the fund balance of Fund 0018, the previous Park Rehabilitation and Development Millage.  We are requesting the funds be made available until project closure, without regard to fiscal year.

Whereas, The City of Ann Arbor owns property within the Arboretum;
 
Whereas, The road located along the south bank of the Huron River on City owned property failed and was slumping into the river;
 
Whereas, The road is used for safety services access, park access, sanitary sewer maintenance and fire hydrant maintenance;
 
Whereas, The University of Michigan has agreed to work cooperatively to repair the road and stabilization of the river bank; and
 
Whereas, Funding is available in FY08 Sewage Disposal System and FY08 Water Supply System Operations and Maintenance budgets and in the fund balance Fund 0018, the previous Park Rehabilitation and Development Millage to pay for the road repairs and stabilization of the river bank;
 
RESOLVED, That funds ($112,500.00) be appropriated from Fund 0018, the previous Park Rehabilitation and Development Millage;
 
RESOLVED, That City Council approves a purchase order with the University of Michigan for 50% of the cost of the road repairs and bank stabilization in an amount not to exceed $225,000.00;
 
RESOLVED, That the City Administrator be directed to approve a purchase order with the University of Michigan for road repairs and bank stabilization in an amount not to exceed $225,000.00;
 
RESOLVED, That this purchase order be funded from the fund balance of Fund 0018, the previous Park Rehabilitation and Development Millage, $112,500.00 (50%);  FY08 Sewage Disposal System Operations and Maintenance Budget, $56,250.00 (25%) and FY08 Water Supply System Operations and Maintenance Budget, $56,250.00 (25%) and that this funding be available without regard to fiscal year until the project is complete; and
 
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
