Resolution to Approve an Amendment to Professional Services Agreement with Wade Trim, Inc. for Design Engineering Services for the Valhalla Drive Utility Extension Project ($66,605.40)

Attached for your review and approval, please find a resolution approving an amendment to the July 30, 2008 professional services agreement with Wade Trim, Inc. (Wade Trim), for additional design engineering services in the amount of $66,605.40
Project UT-SN-06-01, the Valhalla Drive Sanitary Sewer Extension Project, is included in the City's adopted sanitary sewer capital budget. This project includes the construction of an 8-inch sanitary sewer to serve the residential properties along Valhalla Drive that have failing septic tanks and tile fields. Two of the properties are currently within the City and the remaining parcels are township islands located within an area of Pittsfield Township that is within the future intended limits of the City of Ann Arbor. All parcels will be required to pay the fixed improvement charge in effect at the time of connection. We expect to complete the design of the project in 2010 and construct the project in 2011.
Wade Trim was approved by Council on July 30, 2008 to perform the preliminary design engineering associated with this project. The preliminary sewer route consisted of a gravity sanitary sewer crossing the University of Michigan (U of M) Golf Course. However, after the completion of the survey work and reviewing alternate routes for the sanitary sewer, we determined a gravity sewer to the east end of Valhalla, terminating at a new sanitary pump station, and pumping the effluent back up to S. Main Street along Valhalla Drive could be constructed at a lower cost and with less disturbance to the adjacent properties. The design of the sanitary pump station and preparation of maintenance of traffic plans for the work within S. Main Street were not part of the preliminary scope of services as this amendment serves to address.
Furthermore, we are expanding the scope of the project to include the design of a water main to serve the properties along Valhalla Drive. Project UT-WS-10-14, Valhalla Drive Water Main Project, was identified and is included in the current FY 2010 Capital Improvements Plan. This project was also included in our Drinking Water Revolving Fund (DWRF) project plan and has been selected to receive low interest funding. The amendment includes the additional engineering services for the design of this water main in the amount of $15,205.00.
The total amount of this amendment is $66,605.40, bringing the total contract amount to $163,667.85. Of the $66,605.40 requested, $15,205.00 will be funded from the approved Water Supply System capital budget and $51,400.40 will be funded from the approved Sewage Disposal System capital budget .
The form of the contract with Wade Trim is the standard professional services agreement drafted by the City Attorney. Wade Trim received Human Rights Approval on June 10, 2009 and Living Wage approval on April 28, 2009.

Whereas, Professional engineering services are needed in the form of design engineering for the Valhalla Drive Utility Extension Project;
Whereas, The Valhalla Drive Utility Extension project and its associated funding were approved by Council as part of the FY08 Capital Budget;
Whereas, It is now necessary to amend the existing agreement with Wade Trim, Inc., for the needed services associated with the project; and
Whereas, Wade Trim, Inc. received Human Rights Approval on June 10, 2009, and Living Wage approval on April 28, 2009;
RESOLVED, That $15,205.00 be funded from the approved Water Supply System capital budget and $51,400.40 be funded from the approved Sewage Disposal System capital budget;
RESOLVED, That Council approve Amendment No. 1 to the Professional Services Agreement with Wade Trim, Inc. in the amount of $66,605.40 for the Valhalla Drive Sanitary Sewer Extension Project;
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the Public Services Director and the City Administrator; and
RESOLVED, The City Administrator be authorized and directed to take the necessary administrative actions to implement this resolution.
