Memorandum
Attached for your review and action is a resolution to approve a contract with S & J Asphalt Paving Company in the amount of $109,796.00 to renovate game courts, per Bid #3907, and to establish a total construction project budget of $120,776.00.
 
The 2006 - 2011 Park and Recreation Open Space Plan identified infrastructure improvements, including repair of existing game courts, as a high priority.  The condition of courts in a number of the parks are deteriorated and in need of renovation.  Parks that will be included in the court renovation project include the tennis courts at Burns Park and basketball courts at Ellsworth and Leslie Parks.  The highest priority was given to courts in Burns, Ellsworth and Leslie Parks on the basis of their heavy use and significant deterioration that has resulted in safety concerns for court users.  Funding for the court renovation project is included in the capital improvements portion of approved FY 08 Park Maintenance and Capital Improvements Millage budget.
 
Bid documents were advertised on MITN.  Nine asphalt companies submitted bids for the project as follows:

The resolution includes a recommended construction contingency of $10,980.00 (10%) to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $120,776.00 total construction project budget be established for the life of the project without regard to fiscal year.
 
S & J Asphalt Paving Company meets the living wage and prevailing wage requirements and received Human Rights approval on January 30, 2008.

Whereas, Infrastructure improvements, including renovations of existing game courts, are identified in the 2006-2011 Park and Recreation Open Space Plan;
 
Whereas, The courts identified for funding in FY 08 include Burns Park Tennis Courts and Ellsworth and Leslie Park's basketball courts; and
 
Whereas, S & J Asphalt Paving Company received Human Rights approval on January 30, 2008 and complies with the living wage and prevailing wage requirements;
 
RESOLVED, That City Council approve a construction contract, per Bid 3907, with S & J Asphalt Paving Company for $109,796.00 and approve a construction contingency of $10,980.00 (10%) to cover potential contract change orders for a total project budget of $120,776.00 to renovate game courts at Burns Park, Ellsworth Park and Leslie Park for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
