Memorandum

Attached for your consideration is a resolution to approve a five-year services agreement with Advanced Disposal Services Solid Waste Midwest, LLC (Advanced Disposal) to provide Solid Waste Transfer, Transport, and Disposal Services for the City, with an option to extend the contract for up to two additional five-year periods

 

The City issued Request for Proposal (RFP) No. 17-05 to solicit proposals from contractors to perform solid waste transfer, transport, and disposal services for the City.  More specifically, the services requested include:  Operation of the City’s Waste Transfer Station (TS), and transportation of the municipal solid waste materials to a permitted landfill facility for disposal; transport and disposal of dewatered centrifuge cake as well as trash, scum, grit and screenings from the City’s Wastewater Treatment Plant; and, disposal of street sweepings, and vactoring material and soil from City utility construction/maintenance projects, with these materials being transported by the City to the designated disposal facility.

 

RFP No. 17-05 sought to procure a long-term, multi-year contractor for these essential City services.  The City received three proposals from local disposal facilities Advance Disposal, Republic Services, and Waste Management of Michigan (WMM).  All three teams were interviewed by a staff review committee.  Following review of the proposals and the interviews, the recommendation of the committee is to award the contract to Advanced Disposal.

 

Due to the inability to determine the actual end of the need for these operating services and the unknown quantity of solid waste materials that will need to be handled during the contract period, this contract cannot have a maximum, not-to-exceed total value.  Advanced Disposal will be compensated based on the unit prices contained in the contract for those materials delivered by the City or its contractors. 

 

Advanced Disposal complies with the City’s non-discrimination and living wage ordinances.

 

Budget/Fiscal Impact

Funding for these services is available in the approved FY18 (and subsequent years upon approval) Operation and Maintenance Budgets for Solid Waste, Sanitary Sewer, Stormwater, Water, Major Street and Local Street Funds.  Funding for subsequent years will be included in the budget submittals for those fiscal years.

Whereas, Solid Waste disposal is a need of the community and has a significant impact on sustainability;

 

Whereas, The guiding principles for Ann Arbor’s solid waste program focus on providing services that are cost-efficient, customer-friendly, and environmentally responsible;

 

Whereas, Disposal services are necessary to continue uninterrupted solid waste services the citizens of Ann Arbor desire and expect;

 

Whereas, In addition to municipal solid waste (refuse), the City must dispose of wastes resulting from other municipal operations including those at the wastewater treatment plant, street sweepings and soil/vactor materials from utilities operations;

 

Whereas, Advanced Disposal Services Solid Waste Midwest, LLC (Advanced Disposal)  was selected to manage the City’s Solid Waste Transfer, Transport, and Disposal Services requested in the City’s Request for Proposal (RFP) No. 17-05;

 

Whereas, these services will be provided for a period of five (5) years, subject to the availability of funding each year, with the City reserving an option for the City to extend the contract term for up to two additional five-year periods, also subject to the availability of funding;

 

Whereas, City Council wishes to grant the City Administrator authority to extend the Agreement for up to two five-year periods;

 

Whereas, Funding for these services is available in the proposed FY18 Operation and Maintenance budget of the Solid Waste, Sanitary Sewer, Stormwater, Water, Major Street and Local Street Funds; and

 

Whereas, Advanced Disposal complies with the City’s Non-Discrimination and Living Wage Ordinances;

 

RESOLVED, That City Council approve a Contract with Advanced Disposal, for Solid Waste Transfer, Transport, and Disposal Services for five years, subject to the availability of funding in each year, and including a provision that the Agreement may be extended for up to two five-year periods at the option of the City;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said extension of the Agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;

 

RESOLVED, That City Council authorize the City Administrator to approve up to two five-year extensions of the Agreement, subject to the availability of funding; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
