Memorandum
This memorandum and resolution requests approval to award a contract to Atsalis Brothers Painting for the Superior Dam Painting and Handrail Replacement Project in the amount of $203,040.00 and approval of a project budget in the amount of $265,000.00.
 
This project replaces the existing protective paint coatings on the Superior Dam sluice gate and other painted surfaces at the Dam, replaces approximately 650 feet of deteriorated handrail,  and adds approximately 40 feet of new handrail to bring the entire structure into compliance with current safety standards,  the majority of the existing handrail is severely corroded to the point of being a safety hazard.   The sluice gate and other metal surfaces at Superior Dam were last coated in 1992.  The life expectancy of coating systems in such an aggressive environment such as a dam application is approximately 15 years.  Recoating of metal surfaces is a critical preventative maintenance activity to extend equipment life.
 
The City received the following four bids for construction services:
 
Technical Service Professionals, LLC      $112,579.00
Atsalis Brothers Painting                         $203,040.00
Oak Construction Corporation                  $312,400.00
Charles F. Mann Painting Company      $383,220.00
 
Although, Technical Service Professionals, LLC submitted the lowest cost bid for the Project, it is recommended that Atsalis Brothers Painting be awarded the contract for the Superior Dam Painting and Handrail Replacement Project because the lowest bid submitted by Technical Service Professionals, LLC was determined to be non-responsive.  A complete bid required that contractors submit references for dam and/or bridge painting projects completed within the last five (5) years.  Technical Service Professionals, LLC was not able to demonstrate that they have applicable experience; therefore, their bid was rejected.  Atsalis Brothers Painting, therefore, provided the lowest responsible bid.  
 
It is recommended that the bid from Atsalis Brothers Painting for $203,040.00 be accepted, and that Atsalis Brothers Painting be awarded the contract for the Superior Dam Painting and Handrail Replacement Project.  
 
You also are requested to approve a project budget in the amount of $265,000.00 that includes a contingency in the amount of $25,000.00 for Atsalis Brothers Painting for change orders to be approved by the City Administrator, materials to be provided by the City, and City staff labor.
 
Atsalis Brothers Painting has received Human Rights approval on April 4, 2008, and complies with the living wage ordinance.
 
Funds for this project ($265,000.00), are included in the FY08 Hydroelectric Dams Operation and Maintenance Budget.  Because this project requires fair weather, we anticipate that the work will begin in the spring of 2008 and will span fiscal years to finish in late summer.  Therefore, we are also requesting that these funds be made available for the life of the project without regard to fiscal year.

Whereas, The handrail at the dam is significantly corroded and presents a safety hazard for City staff;
 
Whereas, The Superior Dam Painting and Handrail Replacement Project is included in the approved FY08 Hydroelectric and Dam Operation and Maintenance Budget;
 
Whereas, Of the four bids received, Atsalis Brothers Painting provided the lowest responsible bid in the amount of $203,040.00, and was selected as the most qualified firm to provide the services requested at the lowest price; and
 
Whereas, Atsalis Brothers Painting has received Human Rights approval on April 4, 2008, and complies with the living wage ordinance;
 
RESOLVED, That Council accepts the proposal and awards a contract to Atsalis Brothers Painting in the amount of $203,040.00 for the Contract for the Superior Dam Painting and Handrail Replacement Project;
      
RESOLVED, That a contingency in the amount of $25,000.00 is approved to finance change orders to the contract with Atsalis Brothers Painting to be approved by the City Administrator;
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract for services after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
 
RESOLVED, that the following project budget is approved and that funds be available for the life of the project until expended without regard to fiscal year.
