Resolution to Approve Professional Service Agreement with Stantec (not to exceed $250,000.00) for Engineering Support Services
Memorandum
This memorandum and resolution request your approval for a Professional Service Agreement for Engineering Support Services with Stantec.  The City requests that Stantec provide these services as they have local staff, have provided Engineering Design Support Services to the City on an as needed basis for the past three years, and have performed very well.  As part of this service agreement, Stantec will provide resident engineering and inspection services on several construction projects.  The City does not have the capacity to perform this work with existing staff.
 
The City has been able to negotiate a discounted rate for the resident engineering and inspection services with Stantec because of the significant number of staff hours the City will be using under this contract over the next two years.  These services are necessary to allow the City to implement several projects including projects whose schedules were expedited to obtain stimulus funding through the American Recovery and Reinvestment Act of 2009.  Because the City will be able to obtain up to 40% relief of principal on its loans for these projects, there is a significant economic incentive to expedite these projects.  The savings due to relief of principal will exceed the cost of resident engineering services to be provided by Stantec as part of this Professional Services Agreement.
 
It is, therefore, recommended that City Council approve this Professional Service Agreement with Stantec for a total of $250,000.00, to provide Engineering Support Services to the Water Treatment Service Unit for FY10 and FY11.
 
Stantec received Human Rights approval on February 20, 2009, and complies with the living wage ordinance.
 
These engineering services are to be funded from the approved FY10 and FY11 (if so approved by Council) Water Supply System capital budgets.

Whereas, The Water Treatment Services Unit has an aggressive capital improvement project schedule for fiscal years FY10 and FY11, and requires Engineering Support Services to address resident engineering and construction inspection service needs;
 
Whereas, The Water Treatment Services Unit has expedited the schedule of several projects to obtain Stimulus funding through the American Recovery and Reinvestment Act of 2009 which may account for up to 40% relief of loan principal, thus providing a significant economic incentive for the City;
 
Whereas, Sufficient funds exist to fund these services for projects anticipated within the approved FY10 Water Supply System Capital Budget and the FY11 Water Supply System capital budget if so approved by Council;
 
Whereas, At City's request, Stantec provided a proposal to provide resident engineering and construction inspection services on an as needed basis; and
 
Whereas, Stantec received Human Rights approval on February 20, 2009, and complies with the living wage ordinance;
 
RESOLVED, That Council awards a Professional Services Agreement to Stantec in an amount not to exceed $250,000.00, for Engineering Support Services;
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contracts for services after approval as to substance by the City Administrator and approval as to form by the City Attorney;
 
RESOLVED, That the engineering services are to be funded by the approved FY10 Water Supply System Capital Budget and the FY11 Water Supply System capital budget if so approved by Council; and
 
RESOLVED, That the funds be available for the life of the project(s) without regard to fiscal year until the Professional Service Agreements end on June 30, 2011.
