Resolution to Appropriate Funds and Amend the FY10 Stormwater Budget and Approve a Purchase Order with the Washtenaw County Water Resources Commissioner (WCWRC) for Installation and Operation of a Stream Gage at Mary Beth Doyle Park ($38,500.00) (8 Votes Required)

Attached for your approval is a resolution to amend the FY10 Stormwater Fund by appropriating $38,500.00 from the Stormwater Fund balance and to approve a purchase order with the Washtenaw County Water Resources Commissioner (WCWRC) for the installation and operation (June 2009 - September 30, 2010) of a United States Geological Survey (USGS) stream gage at Mary Beth Doyle Park. This stream gage will gather stream flow data on Malletts Creek at the downstream end of Mary Beth Doyle Park. The data is necessary to measure the effectiveness of the Mary Beth Doyle Park stormwater management system that was completed in 2008.
On August 1, 2005, City Council approved a resolution to petition the Washtenaw County Drain Commissioner (now the WCWRC) to reconstruct Mary Beth Doyle Park Pond in an effort to improve water quality in Malletts Creek and the Huron River. The Malletts Creek Restoration Plan identified the reconstruction of Mary Beth Doyle Park Pond as the top priority project for advancing the creek's restoration. The reconstructed pond is designed to control flooding and remove phosphorus from the storm water, improving water quality and helping the city comply with the Total Maximum Daily Load (TMDL) set for this area of the Huron River by the Michigan Department of Environmental Quality (MDEQ). The goal of the TMDL is to remove 50% of the phosphorus from storm water. The stream gage data will assist in determining the effectiveness of the detention system on stream flow and phosphorous removal.
Malletts Creek is an established Chapter 20 County Drain. Therefore, the work to install and maintain a stream gage in the creek falls under the jurisdiction of the WCWRC. Funds to pay for the installation and operation of this rain gage were included in the FY09 Stormwater Fund Operating Budget as it was anticipated that the gage would be installed in the spring of 2009. However, the installation of the gage could not be performed and the final cost determined requires City Council approval. The $38,500.00 is a lump sum amount set by the USGS that covers both installation of the gage and operation for one year. Because the gage is in a County drain, the USGS will bill the County and the County will then bill the City. Because these FY09 budgeted funds were not expended and were moved into fund balance, staff recommends appropriating the funds from the Stormwater Fund balance and amending the FY10 Stormwater Operating Budget to fund this purchase order.

Whereas, Malletts Creek is an established Chapter 20 County Drain;

Whereas, The reconstruction of the pond was completed in an effort to provide downstream flood control and improve water quality in Malletts Creek and the Huron River helping the City to comply with the Total Maximum Daily Load (TMDL) set for this area of the Huron River by the Michigan Department of Environmental Quality (MDEQ);
Whereas, Flow data is needed to determine the effectiveness of the pond reconstruction;
Whereas, The Washtenaw County Drain Commissioner Water Resources Commissioner's Office contracted with U.S. Geological Survey to install a stream gage in Mary Beth Doyle Park that will measure stream flow in Malletts Creek;
Whereas, Funds for the installation and operation (June 2009 - September 30, 2010) of this stream gage were budgeted in the FY2009 Stormwater Fund Operating Budget; and
Whereas, The installation was not completed and billed with a final cost in FY 2009 and budgeted funds for the installation were returned to the Stormwater Fund balance;
RESOLVED, That Council appropriate $38,500.00 from the Stormwater Fund balance and increase the FY10 Stormwater Fund Operating Budget in like amount;
RESOLVED, That Council approves a purchase order to the Washtenaw County Water Resources Commissioner's Office for the installation and operation (June 2009 - September 30, 2010) of a stream gage in Mary Beth Doyle Park in the amount of $38,500.00; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
