Title
An Ordinance to Amend Sections 1:451 to 1:455 of Chapter 17, Reapportionment of Wards, of Title I of the Code of the City of Ann Arbor (Ordinance No. ORD-11-15)
Memorandum
The attached ordinance proposes amendments recommended by City staff to reapportion the City's five wards based on the population numbers released in April with the United States Census for 2010. The target population number based on the new Census data was 22,787 persons per ward. The attached ordinance amendment reduces the size of the First Ward and increases the other four wards, coming within 1% plus or minus of the target. The proposed changes were prepared by the City Clerk and City Attorney's Offices with support from staff in IT.
 
The proposed boundary changes focus on the downtown area in order to follow the guidelines set forth in the City Charter for the creation of the ward boundaries, specifically that the wards are each a pie-shaped segment coming out of the center of the city. The changes also meet the requirements of the Charter and State law that the boundaries be compact and contiguous and that the population in each ward is nearly equal based on the Census.
 
The changes proposed are minor; however, it does move former First Ward areas in the downtown and near campus to all four wards, with the largest sections going to the Third and Fifth Wards. Some changes were made to the original staff proposal following direction received at the July 5, 2011 Council meeting.
 
In order to comply with State Election Law and the Michigan Home Rule Cities Act, staff is recommending that the ordinance go into effect following the August Primary, but in advance of the November General Election. Once approved, final adjustments to the precinct boundary lines will be made by the City Election Commission and voters will be notified of their new ward and polling place sixty days prior to the November 8 election. The proposed maps were presented to City Council at the Working Session on June 13, 2011 and to the public at a forum at the Ann Arbor Library on June 16, 2011.

An ordinance to AMEND SectionS 1:451 TO 1:455 OF Chapter 17 (REAPPORTIONMENT OF CITY WARDS) of Title I of the Code of the City of Ann Arbor REGARDING THE REAPPORTIONMENT OF THE CITY WARDS DUE TO THE 2010 CENSUS
 
The City of Ann Arbor ordains:
 
Section 1. That Sections 1:451 to 1:455 of Chapter 17 of Title I of the Code of the City of Ann Arbor be amended as follows:
 
1:451. First ward.
 
The First Ward of the City of Ann Arbor shall include all parts of the City enclosed by the following-described line:
 
Beginning at the point where U.S. Highway 23 and Nixon Road intersect; then south on Nixon Road to Plymouth Road; then west and south on Plymouth Road to Murfin Avenue; then south on Murfin Avenue to Bonisteel Boulevard; then west and south on Bonisteel Boulevard to Fuller Road; then west on Fuller Road to East Medical Center Drive; then south and east on East Medical Center Drive; then west on East Medical Center Drive to Observatory Street; then north on Observatory Street to Ann Street, then west on Ann Street to Zina Pitcher Place; then south on Zina Pitcher Place to Washtenaw Avenue; then south on Washtenaw Avenue to Geddes Avenue; then east on Geddes Avenue to Observatory Street; then south  and west on Observatory Street to Washtenaw Avenue where it turns into South Forest Avenue continuing south and west on South Forest Avenue to South University Avenue; then west on South University Avenue to South State Street; then south on South State Street to East Madison Street; then west on East Madison Street to South Division Street, then north on South Division Street to East William Street; then east on East William Street to Maynard Street; then north on Maynard Street to East Liberty Street; then west on East Liberty Street to South Main Street; then north on South Main Street to West Huron Street, then west on West Huron Street to the Ann Arbor Railroad tracks; then north on the Ann Arbor Railroad tracks to Miller Avenue; then west on Miller Avenue to Spring Street; then north on Spring Street to Sunset Road; then west on Sunset Road to Beechwood Drive; then north on Beechwood Drive to State Highway 14; then west on State Highway 14 to North Maple Road; then north on North Maple Road to Huron River Drive; then east on Huron River Drive to Foster Bridge; then north on Foster Bridge to the centerline of the Huron River; then east along the centerline of the Huron River to State Highway 14; then east on State Highway 14 to the point of beginning.

1:452. Second ward.
 
The Second Ward of the City of Ann Arbor shall include all parts of the City enclosed by the following-described line:
 
Beginning at the point where U.S. Highway 23 and Nixon Road intersect; then following the easterly boundary of the First Ward to the intersection of Observatory Street and Washtenaw Avenue; then south and east on Washtenaw Avenue to U.S. Highway 23; then north and west on U.S. Highway 23 to the point of beginning.

1:453. Third ward.
 
The Third Ward of the City of Ann Arbor shall include all parts of the City enclosed by the following-described line:
 
Beginning at the point where U.S. Highway 23 and Washtenaw Avenue intersect; then following the southerly and westerly boundary of the Second Ward to South Forest Avenue at its intersection with Washtenaw Avenue; then south and west on South Forest Avenue to South University Avenue; then west on South University Avenue to South State Street; then south on South State Street to Packard Street; then south and east on Packard Street to Arch Street; then north and east on Arch Street to its intersection with Oakland Avenue; then east on Oakland Avenue Tappan Street; then south on Tappan Street to East University Avenue; then south on East University Avenue to Michigan Avenue; then south on Michigan Avenue to Wells Street; then west on Wells Street to Packard Street; then south and east on Packard Street to Stone School Road; then south on Stone School Road to Ellsworth Road; then east on Ellsworth Road to Platt Road; then north on Platt Road to Interstate Highway 94; then east on Interstate Highway 94 to U.S. Highway 23; then north on U.S. Highway 23 to the point of beginning.

Beginning at the point where Ellsworth Road and Stone School Road intersect; then following the westerly boundary of the Third Ward to the intersection of South State Street and Packard Street; then north on State Street to East Madison Street; then west on East Madison Street to South Main Street; then south on South Main Street to Pauline Boulevard; then west on Pauline Boulevard to South Maple Road; then south on South Maple Road to Scio Church Road; then west on Scio Church Road to Interstate Highway 94; then south and east on Interstate Highway 94 to South State Street; then south on South State Street to Ellsworth Road; then east on Ellsworth Road to the point of beginning.

1:455. Fifth ward.
 
The Fifth Ward of the City of Ann Arbor shall include all parts of the City enclosed by the following-described line:
 
Beginning at the point where Interstate Highway 94 and Scio Church intersect; then following the westerly and northerly boundary of the Fourth Ward to the intersection of East Madison Street and South Division Street; then following the westerly boundary of the First Ward to the intersection of North Maple Road and State Highway 14; then west on State Highway 14 to Wagner Road; then south on Wagner Road to Liberty Street; then east on Liberty Street to Interstate Highway 94; then south and east on Interstate Highway 94 to the point of beginning.

Section 2. That this ordinance will take effect on December 1, 2011 following legal publication.
