Resolution to Authorize Professional Services Agreements with DLZ Michigan, Inc. for $370,000.00; Professional Service Industries, Inc. for $530,000.00; Materials Testing Consultants, Inc. for $920,000.00; and NTH Consultants, Ltd. for $140,000.00 for Construction Materials Testing Services
Memorandum
Attached for your review and consideration for approval is a resolution authorizing Professional Services Agreements with DLZ Michigan, Inc. (DLZ) for $370,000.00; Professional Service Industries, Inc. (Intertek - PSI) for $530,000.00; Materials Testing Consultants, Inc. (MTC) for $920,000.00; and NTH Consultants, Ltd. (NTH) for $140,000.00 for construction materials testing services to be performed on an as-needed basis for a variety of capital improvement projects managed by the Engineering Unit. The services provided will include materials testing of soils, concrete, and asphalt materials for construction projects to assure the delivered materials and their placement meet the City’s standards.
In January of 2022, the City received proposals in response to RFP No. 22-03 from five firms for construction materials testing services during the 2022 and 2023 construction seasons. A staff selection committee reviewed the proposals and determined the firms most qualified for the work according to several criteria:
• Professional Qualifications (15%)
• Proposed Work Plan (25%)
• Past Performance (40%)
• Fee Proposal (20%)
Staff ranked the responding firms in the following order:
1. Materials Testing Consultants, Inc.
2. Professional Services Industries, Inc.
3. DLZ Michigan, Inc.
4. NTH Consultants, Ltd.
5. Testing Engineers & Consultants, Inc.
The selection committee decided that the top four firms were qualified to perform the work and found their fee proposals to be reasonably comparable. To provide flexibility and adequate coverage for all the City’s construction projects, staff decided to award contracts to these four firms. Contract award amounts were based on how each firm scored in the evaluation process.
All four firms are in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances.
Budget and Fiscal Impact: The services provided through these professional services agreements have been budgeted and will be paid for within approved project budgets and annual operating budgets, as appropriate.

Whereas, It is appropriate to retain professional firms to perform construction materials testing services for a variety of capital improvement projects managed by the Engineering Unit;
Whereas, In response to RFP No. 22-03 for Construction Materials Testing Services, the City received five proposals and selected DLZ Michigan, Inc., Professional Service Industries, Inc., Materials Testing Consultants, Inc., and NTH Consultants, Ltd. based on their professional qualifications, past experience, work plan, and fee quotations;
Whereas, The construction materials testing services will be paid for within approved project budgets and annual operating budgets as appropriate, if so approved by City Council; and
Whereas, The firms are in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
RESOLVED, That the City Council approve the Professional Services Agreement with Materials Testing Consultants, Inc. (MTC) in the amount of $920,000.00 for Construction Materials Testing Services (RFP No. 22-03);
RESOLVED, That the City Council approve the Professional Services Agreement with Professional Service Industries, Inc. (Intertek - PSI) in the amount of $530,000.00 for Construction Materials Testing Services (RFP No. 22-03);
RESOLVED, That the City Council approve the Professional Services Agreement with DLZ Michigan, Inc. (DLZ) in the amount of $370,000.00 for Construction Materials Testing Services (RFP No. 22-03);
RESOLVED, That the City Council approve the Professional Services Agreement with NTH Consultants, Ltd. (NTH) in the amount of $140,000.00 for Construction Materials Testing Services (RFP No. 22-03);
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreements after approval as to form by the City Attorney and approval as to substance by the City Administrator;
RESOLVED, That the City Administrator be authorized to approve individual work statement agreements for the duration of the contracts; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
